A regular t4eeting of the Planning Commission was called to order
by Atting Chairman Pollock at 7:40 p.m. on August 19, 1970 in the
Plymouth Public: Works; Building.
Present" Acting Charman Pollock, Commissioners Neils, Prekker
Chapman, Planner Bergly and. Engimeer Uagen,
Absent. Chairman Egan, Commissioners June, Roth, Kroskin: and

The meeting began, and Acting Chairman. Pollock wished to make known
to the Council, that any action that gas taken at this meeting was
takerk without fi quorum.. She meeting of 1;ugust Sth was canceled
because of the Lack of members present.
The first item of business was a request for a conOttonal use RE Conditional
permit of Mr« Lyle Haley is operate as an auto jobber with Use Permit of Lyle
machine shop and engine rebuilding facilities in an area zoned Hale;,
B-3 located .at 351.5 .Worth Kilmer Lane. Planner Bergly intro-
duced the subject to the Commission and he reported that this
area was south. of 36th Avenue and west of County Road #18, He
explained that sir. Maley 'is now operating a shop in an area
zoned 3-5. H s kbop is loo ted in the southwest corner of the
section. Mr,. Haley expla;ned that the reason he is requesting
this permit is because his business has expanded and he must move
and find. larger quarters. Planner Bergly explained that he had
talked to the attorney and 'he explained to him that this was z
use that couid be in a B_3 zona.. Ht vis also stated that fir,
Haley's business was more: a minor repair business.. Commissioner
Neils: asked if Mr. Haley's business would be similar to M & I
Auto Parts in Goldan Valley. Mr. Haley stated that it would be
very similar. Acting Chairman. Pollock asked if the requested
site would be big enough for him in the coming years, for if
he wished to approve the request he would like the building to
be large enough for five years or more. He said if the request
was a ;long. --terra proposal that the, consideration; can be set in
mind. It vas explained that the building sits on the south
end of the lot,. Acting Chairman Pollock asked Air. Haley if he
anticipated any outside stor;ge in this area and Mr4 Ilsley
answered th ,a question. as no and he explained that lie wants to
keep the appearance of the site clean and neat, Acting Chairman
Pollock asked if anyori else wished to speak in favor or against
the proposal. fir. Haley then told the Commission that other
Villages consider tj2,J4 In the same category as a service station
and tbis is classified as. commercial.
Commiseionec Neils then i xpressea t-&at. even though the Commission

some conditions in respect to parking, landscaping, cle&aup and.

ett. as conditions of this permit. Acting Chairman` Pollock. stated
that if the Confit ss.ion wished that they could require that the
area be bl,acktopped and curbed,. Pjant cc r BerglY stated that this
area was of con:iern to the Commission. Commissiosaer Nee l,s asked
if it would be -appropriate to set a condition of site improvement
to conformance with the ordinance to be set fo-:rh by the Planner.
Engineer Hagen stated that the parking should c6aform to the
setback$
CommissionerNeils made a motion recommending approval of the MOTION
requested conditiona use permit saying that the parking should
be in accordance with the zoning ordinance requirements and no
parking shotild "be allowed at the setback area 'which was seconded
by Cor issl6ner Prekker. Commissioner Neils felt that some
time limit should be givenr Commissioner Neils amended his
motion to include a time limit: of one year to complete these
site requirements, The motion was moved and seconded to the
above stated requirements,. All were; is favor of the motion.
The next item of business was a request for a conditional use U Conditional Use
permit of Mr* David Benner to operate a body shop in aL B-3 Permit for David
zona located at 3510 Kilmer Lane. Acting Chairman Pollock Benner
said that he had talked with the. Village attorney and he said
that u body shop cannot be constxewed in this district. lie
suggested that it should be xeturned to the Village Zoning
Administrator and it would then be his decision as to what
he would do. He said that the request is specifically list-
ed in the B-4 and therefore there is no question of intent,
aw to where this should go. Commissioner Prekker asked how
long this business has been going on and Mr. Benner stated
about, 2 months Planner Bergly explaiaaed ,that the street
was once part of an; up -grading of County Road 18. Acting
Chairman Pollack said that they are looking for a motion to
deny the request tbLat it is improper for -the area. Acting
Chai'rmau ?olloak explained that it was dome by permit and
suggested. it 'could be ret:irned. to the zoning administrator
and it will be 1ii.,s duty to either refuse or accept this
application and he also told fix. Benner that if he wants he
can appeal, this and take it to ,the Board of Zoning Adjustvnent
or he can, try ;to rezone the property to B-4, which is a per-
witted zona..• , for this.
Commissioner 'Aeils moved that the request be sent back to the MOTION
administrator as in Invalid request according to the ordinance
and, Commissioner Chapman seconded the motion, An all in favor
vote` carried the motion
The next item of business was, a request for a conditional use KE Conditional Use
permit needed for site plan approvalof fir. Harold Posnick for Permit for Site flan
permission to use a plastic pool cover to cover swim pool at Approval: of Harold'
3636 LAncaster Lane during the cold weather months. Mr. Posni.ck Posnick
said that be had already had the cover on the pool last winter
without a permit, but if he needed a permit he was willing to
get one, Bngineer'Hagen explained that the cover is quite sate,
because if it rips it rips only in small squares and also it does

not burn. The only question the. Commission had was °the safety
of the cover, Xr, Posnick explained that the cover was just
temporary and was put away during the summer months., Mr.
Posnick explained that the cover has comethrough 'Winds of 40-
45 miles per hour. planner Bergly asked as to: how far into the
winter was the pool usable;, and Mr. Posnick aatl from. about
Pebruary, on. The Commission asked Mr. Posnlc. about installing
an alarms system so that people would have tint,, •t.) get; out of

Commissioner hrekker moved approval of this req_,est and Com- MOTION
missioner Neils seconded the motion. The motion was carried
by an, all in favor vote,
The next item of business was a site plan approval for .Paul.is RE Site -Plan Approval
Woodcraft expansion, located between Fernbrook Zane and Inter for Paul's Woodcraft
state X494 and south of Hi$hway< 55. Planner Bergly- explained'
that a request was before the Commission a fcw years ago and
at that time we received a site plan and approved it:. He said
It was approved and built and after looking at the site itwas
not developed the same as the site plan which was approved. He
said that the setback i.s not the same and also not all the parking
spaces are being used. Planner Bergly made recommendat,+ots to
the plan which are as follows:
1. Allow only 3 stalls in the 50 foot iron yard setback..
2. Allow 3; morer stalls west of the 35 shown along the
south on the submitted plan, such that they won't be
in the setback area.
3. Remove the blacktop, replace with: sod and properly
landscape .the setback area just recently blacktopped
for parking.
4. Allow parking gest of the Ist and 3rd additions to
replace those lost in I" above.
5. Remove the parking stalls along the east property
line in setback area,
6. Caner to submit revised plans including landscaping
for approval. by Planning Consultant Bergly,
lair. Zeltins, the President, explained to the Commissionthat over,
the, Fourth of duly when he was away, they blacktopped the entire
area, and now he wants` to wait until l+ernbrook is finished before
they Cake the blacktop off and replace it with sad. Commissioner
Prekker asked what the 'Lot coverage is, and it wigs answered to be
about 42.7%. Commissioner Neils asked for the approximate completion
schedule of Fernbrook and in.gitmer Hagen stated that it should
be blacktopped by next spring. Act1mg Chairman; Pollock asked if
there would be any objection to raovlag the three parking spaces
in the setback area and leaving that area, into a green area. Mr.
Zeltins said that they have enough parking and they ,could do that.
Engineer Hagen suggested they give Mr. Zeltins a time limit
as to when the sodding should be finished.

Commissioner Neils moved approval subject to Planner Bergly's re- MOTION
coumlendations for changes plus the removal of all parking
stalls in the setback in the front of the office project vith
an allowance of one years; time for completion of site plan
improvements, which was seconded by; Commissioner Chapman. Couir
nissioner Neils then amended the motion to relocated the custozor
parking from its present location to the front of the, first
addition, which was again seconded by Commissioner Chapman.
Commissioner Chapman questioned, item number bix of the re-
commendations. Cozmnissionea. Pi ekker said that the revised
plans should be given to Planner ltergly so that he can check
can them.. Planner Bergly stated that the thing they are in,-
terested in if they meet the ordinance. The motion was,
carried by an all in favor vote.
The neat item of businesswasthe request for a conditional use. RE; Conditional. Use
permit for the constructiozx of a wavehous:e and transfer s.tatibn Permit for 11 rning
with offi^e facilities to be utilized by Morning Fresh Dsiry,, Fresh Dairy, by
Inc. The building wil he used for the transfer of dairy, pro-- Mr. Harrington
ducts from.a, large over the road truck to smaller delivery
trucks for distribution;. lie building will also include coolers
for the storage.: of dairy products. No milk or dairy processing
will take place on the site.
Mr. Harrington appeared and presented his proposal stating that
he, intended to construct a prosect on lots 26,, 27, and 28 of
Plymouth Gardens rather than on parts of lots as originally
proposed. The original proposal was denied by the staff be-
cause it entailed a division of lots which would l.andl,ock an;
existing. building located 'on, 'Lot 25.
Planning Commission members objected also to the proposed location
of the building with parking and loading facilities in the setback
area, al.oncr 10th Avenue. Mr. Rarrington agreed to the removal of
parking and loading ,areas on the north and east sides of the
building in the setback areas and further afire d to increase the
building setback so th*t the 50 foot requirements from 10th
Avenue would be met. He also agreed to: xe.tvvi,ng the: loading
door which is called for on the north silo of the warehouse poxtiotr-
of the building,and the installation of a sidewalk to run from
the parking lot west of the building to the kront door of the
office structure, Acting Chairman; Pollock s:.ated that, he would
like to sec the business setting; a good example along County
Road 1.8 by advocatin& curbing on the: proposed parkin; lots.
Commissioner Neils,was concerned about the curb driveway app;:oach.;
He. said he would like to see the driveway curbed to the :setback
line from the County Road 18 frontage road.
Commissioner Neils recommended approval of the Site Flan subject MOTION
to the petitioner provideing a revised set of drawings for review
by ttze Village Consultant John Bergly,
1. Site flans would include the removal of the parking
and loading ;area on the north side of the building in
the 5Q foot setback area.:
2. The removal of the driveway access from County Road 18

frontage road at the northeasterly corner of the Site
3. The planting of sod in the setback area where the proposed
driveway and parking areas were indicated on. the north
side of the building,
4. The increase of the setback. along 10th Avenue from the
property bine to the building. to 50 feet.
S. The removal of the large loading door on the north side
of the warehouse,
6, The increasing of the parking and loading areas on'the
south and west sides of the building in conformance with
the zoning ordinance to provide adequate parking and loading
a ace w -
The motion =teas seconded by Commissioner Prekker'. The motion was carried
by an all in favor vote..
Commissioner Prekker then asked if anything was heard from the RE;: MINNEAPOLIS
Aii.nneapolis &. Western Railroad. Engineer Hagen 9 aid he met & 14ESTERN RAILROAD
with, Bonestroo and, found that a public 4earing was held on the
abandoning of the. railroad. They hiid asked for abandonment
west of Vicksburg Lane, tithing has been resolved on the matter
to date.
Next, ;the Commission set a date for the Section 1.2 Public Hearing. RE, Date Set for
A new notice is to be. placed In: the paper. Commissioner Prekker Section: 12 Study
made e motion to hold the %oaring on September 164, which was
aeconded by Commissioner Neils„" An all in favor vote carried the
motion.
Engineer Hagen then said, that the thoroughfare plan has been: RE Thoroughfare;
complete except for a couple of changes made on it. He said Plan
that further commends to the Cotfi;i,l should reach them by
September 14, for at that time they will have a schedule -as, to
how the public hearings should be held. Planner Bergly sug-
gested they hold off the public hearing until the Guide plan
is completed, Engineer Hagen stated if they keep waiting they
Will lose 5 mile of Municipal Slate Aid allotment from the 'State.
The minutes of July 15th will, be approved at the: next meeting of
the Planning Commission.
