A regular meeting of the Planning Comn3ission was called to order
by Acting Chairman Pollock at 7:40 p.m.. on .; aly 15, 1970 in the
Plymouth Village Hall.
PRESENT44 Acting Chairman Pollock, Commissioners Hafner, Neils
Roth, June and Engineer Hagen. Commissioner Chapman
arrived at about 7;50 p.m:.: and Commissioners Kroskin.
and Prekker arrived at about 8:15 p.m.
ABSENT: Chairman Egan and Planner Bergly
The first item of business was a public hearing on petition RE: Public
of Elmer Robeck to change the zoning from R--0 to B-3 located hearing for
in vicinity of Zachary Lane and Rockford Road. rezoning from
R--0 to B-3
Engin&er Hagen explained to the Commission that the by Elmer
party requesting the rezoning wishes to establish a Robeck
nursery and they needed the area rezoned to B-3 so that
they may sell their products.. He .poi.nted out to the:
Commission that the proposed area lies east of Zachary
Lane and north of County Road 9. Mr. Robeck showed a
map of the area that he wished to rezone.. It is the
area which runs from Zachary Lane almost 200 feet to
the east and from County Road 0 1?00 feet to the north.
He told the. Commission that he Gould have the driveway
come offof Zaohary Lane and County Road 9.
Commissioner Neils questioned the size of the remaining
parcel. Engineer Hagen read a report by Planner Bergly
regarding the use of the entire parcel of Land.
Acting Chairman Pollock asked for anyone to speak in.favor
or against this request.. A man from Revere. Lane North
questioned whether the Tillage has a master plan for the
area of development.. Engineer Hagen said they have a
Section 12 Study which comes down to just about County
Road 9 and almost covers the corner of the land in question.
He said that there will be a new County Road 9. He said
that they are trying to get the entire area reviewed under
an additional plan,. The Commission pointed out that the
Guide Plan must first be reviewed before any decision can
be made,.

Objections were made as to the rezoning of this area, not of
the nursery itself. The people were concerned with the re-
zoning of the entire area, not just a section of it. They
felt that this entire area would be developed
Comrni,, siorer Hafner` stated that in no case should a B-3
district be located in a residential area, The Village.
Ordinance -was read and it became clear that an outdoor
business should not be conducted in this area. Commissioner
Prekker said they would .have to provide the necessary grounds
as far as set back was concerned. He also adked how the
ordinance would, comply as to an R--4 Being adjacent to a comp:
mercial area. Commissioner Pzekker also stated that the land
located around on the west, north., and east side is all
zoned R-0 and that the rezoning south of County Road 9 is R-1.
The question was then raised if the R-4 had the same, restrictions
as the B-3« The question was answered as it did not and a
list of what could be placed in this area was read from the
Zoning Ordinance Book.
It was stated by the Planning Commission that they must keep
in mind that the use may not be objected to as far as the
proposed use of the land, but his request may be objectionable
to other uses by residents if this 'Land was rezoned. It could
be used for many different uses besides a nursery. Acting
Chairman Pollock stated that this was one area which was to
be reviewed, It was said that nothing at the present time
could be built up on the land but R-1. development. At the
present time it was decided that it was impossible to grana
this rezoning request. Commissioner Neils stated .that in
no case should a B_3 district be next to an R-1 area.
E1 Aronson was in favor of this development. Commissioner
Neils asked what the present progress was on the Guide Plan
for the areaa of Lost Lake. Sometime in August was set up
of the first presentation before the Planning Commission.
Engineer Hagen stated that Planner Bergly had drawings
which included a survey, which indicated that this is a
possible business area because of the limited area, it is
doubtful whether it would serve any other purpose besides
a omall, business. Commissioner Hafner stated than when
you rezone anything to business you have the people who may
not favor it. fie said a nursery would be best~ because .. it is
the easiest thing to get rid of. Acting Chairman Pollock
said that he felt that when Zachary Lane is opened: on the
south that a gas or service station will be a first request.

Commissioner Neils felt that the plan was not advisable at
the time. The glen were told that there was no commercial
in this area: now on the guide plan and that they must review,
the plan and see if they want to do this,
Commissioner Chapman moved request by denial until the area MOTION
guide plan has been established. Commissioner tlafner seconded

Commissioner June said that they should not deny the request
because this was. -What was suggested to the petitioner when
he came in. .A 60 day' deniel was; suggested but felt unwise
because within 60 days if nothing was done, Mr. Robeck could
go straig4t to t.ne Council. Commissioner Roth 'asked what
the action said that was taken by the Council. Commissioner
Hafner once again stated the motion to the Commission upon
calling for a vote. The motion was carried to deny the
rezoning until the guide plan is finished by a five in
favor, Commissioner June opposed? and Commissioners Kroskin
and. Prekker abstained,
The next item of business was a public hearing on petition RR: Public
ofJohn F. Boyer and Dale R. Kennedy to change the zoning hearing for
from R-1 to R-3 in the vicinity of 15th ,Avenue and Rose- rezoning fro
wood Avenue. The present proposal is the rezoning of lend R-1 'to R-3
located on 15th Avenue and Rosewood: Avenue. His proposal, by John Rx
is to rezone so that he may build two double bungalos on Boyer and
the tats. He then changed his request of rezoning to R-2 Dale; R.
which is all that is necessary. Kennedy
Commissioner Rafter asked if the lots would conformwithth
the width requirements because one of the lots is less
than 1.1.0 feet. CommisN oners Rath and Kroskin both asked
how many homes were presently located in Block D. This
question was answered that 2 homes were located on Pineview
and between lath and 15th Avenue. The corner lot is vacant
for the -use of a storm; sewer into lKedicine ' Lake. Commissioner
Kroskin asked ghat is directly south and it was answered that
this belonged. 'to MIP. The .question was asked as to how
permanent the water hole was on the south side of the property.
Engineer Hagen, said that From about 1,9,64 to the present it
shows a ponding area in that location and that it was part o
the storm sewer system, Acting Chairman Poilockc stated that this

is a rather permanent thing. if this was permanent, maybe the
lot should be split the other way, as to avoid this hole as. much as
possible
Acting Chairman Pollock asked for those to speak either in
favor or against the proposal.. James Anderson of 1335 Pixy:-
view Lane was the first to speak against the proposal. He
said he was one of the group, of homeowners who * as petitioning
against this proposal", He showed and read to the Commission
a petition signed by 15 different people in opposition to
the rezoning. He asked that the petition be placed in the
minutes, Nkich reads as follows:

lie, the undersigned to hereby petition against the rezoning,
as stated in the subject' matter of the petition, Significant
points for consideration are as follows
I .. ie .feel that this rezoning would adversely affect they
value Of our p370perties in that multiple dwellings would
be adjacent to or near our properties.
2. By taking the action considered, it would 01open the door"
for rezoning the property adjacent to 15th Avenue and
Pineview Lane from R-1 to R - i. . Aga i.n, we fuel this would
adversely affect the value of .out properties.
3. Our homes .were purchased with the understanding that the
property in question would be for single family dwellings.
4. Our present property values have already suffered in that
Orchard Lake; which is adjacent or near our properties,
was once a beautiful, small lake. It is now a stagnant,
mosquito infested swamp. it is noteworthy to iioint out
that this deterioration took place after instal.l.ation of
the storm sewer.. We were told in person by village
officials that the aesthetic value of this lake would
not be destroyed. Once again our property values: have
suffered.
5. We respectfully request notification: of action taken by
this Commission so that we may properly determine our
next course of action.
Commissioner Neils then explained to the people; the difference
between. R-2 and R-3. He, then, questioned

Mr. Boyer then explained to the Commission his attempt to sell
the lot,, but he said he could not sell this land, He wished to
make use of the land and felt that double bungalos would be
the best thing to place upon this land. Mr. Anderson then told
the Commission the effect that lie felt the double: bungalos.
would have upon the lake. He showed the Commission a picture
of the lake before the storm sewer went in, and he also felt
the double bungalos would place an even greater effect upon
the lake.
Leroy Zeller of 12905 l5th Avenue North then asked what they are
going to do about the open storm sewer. Engineer Hagen then
talked about the probze;n of the storm sewer pond in the area.
Commissioner Chapman moved that the request vo be rezoned to R-2 MOTION
or R-3 be denied, which was seconded by Commissioner Neils.
The motion was carried by an all in favor vote. The petitioner
asked that the matter be brought up at the August 3rd meeting.
The next item of business was a regti st for a conditional RE Condit -
use permit of Lorraine H. Beam so she may preform dog ional Use
grooming and beauty work in her home located at 1.1625 Permit of
is State Highway 55. Lorraine

The motion was moved by Commissioner Xroskin and seconded
by Commissioner Neils to permit her to do so An all aye MOTION
vote carried the tuition.
The next item of business was the Site Plan ;Approval for RE: Site
Belgarde Apartment,: in Fox Meadows Plat located at the Plan Approva
intersection of Fernbrook Lane and State HA.ghway 55, for Belgarde
Apartments
Engineer Hagenstated that Planner Bergly's office has
already, rzvie iTed these v.aps . He also said that the
Council had already accepted it, The only thing that they
wanted to see was how they planned to landscape the buildi tg.
The de.vel.opment contract calls for landscaping the area
around the dwellin s of the residents.
Commissioner Chapman made a motion to approve total. site MOTION
plan, which was seconded by Commissioner Prekker.
Commissioner Hafner asked what types of trees would be
placed around this area. Commissioner Kroskin said he
would like to here Planner Br:gl.y say that it has received
the review by his office.
Commissioner Chapman onr-e again made the motion to approve MOTION
the total site plan provided it is approved. by Planner

Prekker, The motion wa.s carried: by an all, aye vote.
The next item of business was old business of United Land lam. United
Rezoning request in the vicinity of the Village Hall. sand Rezoning
piz perty4 Mr. DeZiel said he would like to get a request of
rezoning of the: property.. He said he has been waiting Village Hall
for almost 2 years and he feels he has been, patient area
enough,. He said that a public hearing hay, already been
held but that the matter was held over because of the
development for the: guide plan. lie said he has not yet
had the chance to even -talk for the rezoning cif his
prc'per ty
Acting :hairmar Pollock said that no one has yet had the
chance to see these plans, arid, that they need to be studied.
Mrd Da i.el said he -would shift hi,,,plans if he were given
the rezoning of the property, He said he does not want to
wait much longer because he wants to get started on this
before winter, so he does not have to pay 'taxes on empty land
for another year.
Commissioner Kroskin made a motion that they do not take M011ON
action on this request at this meeting, but that they refer
it to -the staff, which was seconded by Commissioner
Prekke.. Commi s i.oner Prekker amended the motion that a
special meeting of the Planning Commission should take
place on July MCI, in order twhd_ Mr, DeZiel may be able
to begin with his plan. The motion was seconded by Commissioner
Chapman
Commissioner Kroski n asked Mr. DeZiel to let the Commission know
specifically what he is planning to do, All, were in favor of
the motion
Commissioner Prekker made a mot -.on to have Planner Bergly or MOTION
Engineer Hagen investigate what the Minneapolis and Western
railroad is planning to do; if they will discontinue their
use or 'keep the rei lroad open. They Tyrant the railroad to
send them a !Viter stating thein -plans, All were in favor of
this
The next item of business was to set a date for the publ.'.c RE: August
hearing of Section 1.2 Study, 5th set. for
Section 12 Study
Motion was made by Commissioner Tune, seconded by Cont
mi, sa oyer Chapman to set the date for this Study on MOTION
August 5th. All were in fsvor of this motion.

Next, was a discussion by Commissioner Neils of the failure M Park
to keep up with the parks in, the area. He deeded that a Committee
committee should be m,-de and these men who serve on the formed
committee should set their own language of communication.
This way they will be able to keep up with what is going
on. Commissioner Neils was made, Chairman of the committee
Pnd CoTtmissioners Hafner and Pollock agreed to serve on
this committee,
A motion was made by Commissioner Chap: hn and seconded by Com-- MOTION
missi,oner Prekker that the meeting be adjourned'. The
meeting was adjourned at 10:10 p.m,
