Mr. Darold Rosen, 1472 Larch Lane, ,yxpressed his feeing
that there would be a Large number of school chitldren
emanating from the apartment project which would cause
a stress load on the Beacon Heights school. He also
asked whether sewer and ,Tater in sufficient capacity
was available for the site:
acting Chairman Pollock stated that after all of the
questions were asked by the opponents the answers to
several questions would be given,
dim Cavanaugh of 1220 :fives Lane indicated his opposition
to the proposed rezoning.,
Dr. Gibbons, 1.320 Ives Lane, asked if the proposal was
compatible with the Village plan and further asked if
a plan really existed for the Village in general, and if
the proposal would support- itself tax -wise in the future.
He statedthat he did not feel that the railroad tracks
would really form a buffer for the residential area to
the south and asked for a delay or a rejection of the
rezoning.
Bil Ttausch, 1.450 Larch Lane, objected to the rezoning as
a creepIng density of development in the residential
area in which he live:,
Jim Brown, 14.14 Larch. Lane, asked if a public hearing
had been held on the previous. rezoning. Mr. Bergly
stated that this had been clone but that the Village;
Ordinance in effect at the time of the previous rezoniiig,
which was in conformance with the state planning law,
stated that residents within 200 :Feet of a proposed
rezoning needed to be notified. she presentVillage
Ordinance requires notification within 400 feet of the
and 'to be rezoned; hence, they were notified at this
time.
Actil airman Pollock asked. Mr. Bergly to explain the
Central, area Qorh,rehensive Plan since so many questions
were asked about such a plan whereupon Mr. Bergly outlined
the various features of the Central Guide Plan.
Lois' O t Connell of 2020` Oakview Lane asked if the Minnesota
Highway Department had approved a proposed. interchange
for County Road 6 and Highway 55. planner Bergly indicated
that they had not but were studying a plan.

The Planning Commission meetiag was opened at 7.30 p m. by
Acting Chairman Pollock with an..explanation to the audience
of :he procedure followed by the Planning Commission,
PRESENT: Acting Chairman Pollocl,c, Commissioners Kroskin,
a
Neils, Roth, and Juat Commissioners Prekker
and Hafner arrived, at 9:30 and 9:35 respective-
ly, Also present ;pare Plamer Bergly and
Engineer Hagen.
ABSENT.- Chairman, Egan and Commissioner Chapman
The first order of business was: the opening of a public RE; United
hearing on the petition of United Land Company to rezone Land
property located near Highway 55 and the Minneapolis and
Western Railroad tracks from.. R-1 to k-4. Planner Berglq
explained the proposal and the history of the zoning in
the area.
The applicants°`. case for the rezoning was explained by
Harry Dezeil and tick Knutson. Mr. Knutson indicated that
the applicants proposed to construct 644 apartment units
on the site, all of which would have underground garages
for at least one parking stall per unit. He stated that
some of the area had a bad soil condition which would re-
quire pilings under the buildings which cost would preclude
a single family residential development at this time,
He indicated that: 18th Avenue and Larch bane, within the
petitioned area, would be dedicated as public :roads. Ile

swimming pool included as amenities to the site,
The proposed rezoning, whish would enlarge the presently
zoned R--4 area lying northerly ,of 18th Avenue, .was stated

Central. Guide Plan.
Acting Chairman Pollock asked for comments from opponents-

Dick. R,utger, 131.0 Ives Lane, asked who made the final
decision on tonin: matters;. acting Chairman Polloclk
indicated that it was .the Village Council who made the
final decision an4 that the Planning Commission acts,
in an advisory capacity.
Acting Chairman Pollock then asked Dick Knutson t,o
answer the various questions of the opponents In
the matter of access he acknowledged that here eras an
access problem and that the present proposal would be
a temporary connection to Highway 55 at the Deitz
driveway, He indicated the permanent connection to
the apartment complex would be 'a connection to the
new alignment' of County Road b north of Highway 55.
He stated that it was planned to build the apartments
in stage6 over the next three or four years in order
to take advantage of possible changes in highway planning.
In connection with, utilities, he stated that sewer was
available on the site and adequate to handle the facility
and that a water main must be ,jacked under Highway 55
to carve the; area,
Ivtr. Leonard Jankowski., 308 North Balsam Lane stated that

by the apartment complex he felt from experience that
there would be very few school age children is the
apartment complete.
In regard to the compatibility with the Guide Plan,
Acting Chairman Pollock indicated that apartments are a
residential use and are sometimes used as buffer zones
betw(,.,:_,n single family residential and denser commercial
and Ludustrial uses but should not be limited to this
cap. e&ory.
With. regard to the recreational facilities, Mr. Knutson
again explained the proposed recreational facilities on
the site which were to be used by apartment residents.
There 'being no further questions from the floor, Acting
Chairman: Pollock asked if any Commission members had
quostioi..s or comments. Commissioner Kroskin asked if
the proposed access on Highway 55 had been changed from
the previous proposal upon which the Planning Commission

had requested; reconsideration and ,"ssible change.
Mr. Xnutson said no real change of ocation of access
on Highway 55 was proposed. Planner Bergly showed a
slide indicating the possible effect of the Guide Plan
indicates' relocation of Highway 55 on the proposed apart-
ment complex.
Upon: further questioning about building heights and
elevations, Mr. Knutson indicated that the railroad
tracks are at an approximate 910' elevation ,and that
the garage floor of the closest building would be

Acting Chairman Pollock opened a public hearing on RE:
the proposal of Plymouth Village to rezone land located Rezoning -
between Fernbrook Lane and Niagara Lane, northerly of lymouth
23rd Avenue from R-0 to I-2. Engineer Dagen presented Garage &
the proposal indicating that the land vas being rezoned State
for the location of a 'Village Garage and maintenance Drivers
yard andwater system facilities and for the proposed Training
Minnesota Highway Department maintenance facility and Station
driver training station. No one appeared in opposition
to the proposal.
Commissioner Krosk_in made a.motion, seconded by MOTION

Acting Chairman. Pollock openers the hearing on the RE:
p-tition of Eel.garde Enterprises requesting a conceptual Belgarde's

the proposed Harbor Lane. Planner Bergly explained the
suggested changes in site plan details and indicated that
the petitioner was not asking for a conditional use
permit for site plan approval but only for conceptual
approval.

Mr. Teigen,. representing Belgarde Enterprises, explained
the plan and thinking of the project and stated that
work would be started as soon, as possible with half of
the project to be completed in the early winter of 19711

element in the successful relationship to abutting
single-family property„
5. That facilities for storage of garbage and rubbish. be
included in the ends of the garage buildings and
further that they be completely enclosed, and: roofed.
That the ;grading, drainage and utility plans be
reviewed and approved by the Village Engineer.
All members voted aye with the exception of Commissioner
Prekker, who had just arrived at the. meeting.
The noxt matter to be discussed was the Committee Report RE:
concerning the realignment of County Roads 15 & 61. Realignment

showed a plan which indicated the relocation of 'County
Road 15 to the north so that it {would follow the lower'
land and allow .a narrov sliver of land that could be
developed as a two-family .area. The plan indicated cho
moving of Highway 61 to xthe west in the low, area westerly
of the center of the scot ,on with the Land lying between
the roadway and the residential area to t,e used for town-
houses, The extension of County Road 61 would go on the
gest sida of the existing church property located south
of existing County 15,,
Bruce Carlson, representing tUnneapoli.s Industrial Park,,
statedthat he felt the existing guide pla.az should be
followed; much the same as MIF has been told to follow it
in their rezoning request for the lend area lying north
of fi,.R.#55.
Mr, Richard Cox presented -a plan of an alternate location
for Highways 61 and. 15, whi,,L would relocate T.H#61
roughly a:l.,ng Berkshire Lane, extended between present'
County toad 15 and th, unused bridge across Interstate
494 south of County Road 15.
Much discussion revolved around the proposed alternate
plan. Upon questioning by Cotihaissioner Kroskin, Planner
Bergly expressed his view that moving County Road 61
west of the hill in the center of Section 34 would be a
good plan and would take advantage of natural terrain
as a buffer.
Commissioner Kroskin made a motion, seconded by Commis-- MOTION
sioner Prekker, to lay the matter over to the June 17th Ta hold
Planning Commission meeting. Upon calling for the vote, over to
one aye was expressed, and the balance voted nays The June 17th,

Ipon discussions of the motion, Mr. Carlson, representing
MIP, stated that MIF did not contest the rezoning to a
lesser use any portion of the I.1 district which would fall
easterl- y ;and southerly of a.ny proposed road changes. Upon
calling for the vote, the motion was carried by an all aye
vote with Commissioner Kroskln abstaining.
Mr. Er.ckson an attorney representing Northwestern RE:
College, appearedbeforethe Planning Commisaion and Northwestern
asked for consideration of a zoning ordinance modification College
to allow the construction of a radio tower on the proposed Radio Tower
college site, He stated that Ur. Le:r-ler and Mir. Dahlgren
had recommended that the zoning ordinance be amended to
allow radio towers of the nature proposed to be installed
when desired by Conditional Use Permit.
Commissioner Hafner moved that the Coruni,ssi.on proceed MOTION

Acting Chairman Pollock presented a report of the Sub- RE:
division Committee regarding the Ponderosa and Fazendi,n Park
Pare Home Owners Association for handling park mal'nten- Maintenance
once. After a discussion on the matter,, the Commission
recommeixded and informed Mr. Oscar Naust°dal that the
Subdivision Committee would meet and dis:}ecus s the Ponderosa
Plat at 6:30 p.m.; on June 3, 1970 before the regular
Planning Commission meeting,
The next matter of business to be brought 10efore the RE:
Planning Commission was the request of Mr. Nord to Renaming

to Evergreen Lane, This request was brought up because Avenue to
