April 29, 1970 Commissioner PoV ook moved for approval of site plan MOTION including the variances of 4 feet. and 5 feet respectively on the parking setbacks along 'the side and rear entries, all subject to engineerity- approval of grades. Commissioner ,dune seconded the motaoxi. ,Motion carried by aye vote with exception of Marren Chapman opposed. Mr. Cox indicated financing has been arranged, and a stagy ding date of July is proposed. Site plan approval was requested by Richard Cox for a RE; series. of 5000 square foot modular industrial buildings Park located on Industrial Park Borlevard,, Planner Pexgl.y Industrial pointed out that we have not had more than one building V3411age - on one lot, and Mr, Cox replied that a lot of companies 5000 sq.ft. need 5000 square feet of building, gs and with thistype of modular building a tenant could expand little by little. He also buildings indicated that it is a waste of Land to build a whole lot of individual buildings, and furthermore it's too expen- sive. Commissioner Hainer asked if all these buildings are for warehouse purposes. Mr.. Cox replied they would be for warehousing and manufacturing purposes. Commissioner Prekker then asked if a conditional use per- er- mitmitis needed then for these manAfacturing concerns. Commissioner Chapman expressed concern about trucks stack- ing up, and Mr, Cox indicated an allowance of one unit for each 5000 square feet. Chairman, Egan asked when building would start and how long it would take. Mr. Cox replied that building would start this summer and would take three years. Chairman Egan expressed concern over fire protectioa and indicated he would want the fire chief to lake a look at the project. Commissioner Prekker made MOTION a motion to refer the request to the Zoning Committee for: study and a report to the next meeting. Commissioner Neils seconded the motion, and the motionn was carried by unanimous vote. Rngineer Hagen related the history of the request for re- REt zoning by MTP for the area lying generally south ofthe MSP Rezoning Minneapolis Western Railroad and easterly of Interstate 3rd Addtn) 494, This request had been referred to the Plat "Committee to study rerouting of Highways 15 & 61.. Commissioner RolloC*K stated that residents object to the proposed align- ment. of the county, hi&gays, and that the Planning Commi.sa.ion had recommended: that the staff arrange a meeting With the county to ' deteiTaine the feasibiUty of realignment. Mr.. Hagen conutented that the highway depax tment had `uggest ed the alignment be resolved on, the communit y level: and 'then brought back to them for approval. PRIL, 291 1970 A regular meeting of thr- PT%nr i:ng Cc:nmission was called to Order by Chairman Ed Efi! it 29, '970 at 7:30 p.m. PRESENT: Commission •finer, Po Ilock, Chapman:, Neils, ',Rot an Egan, Engineer Hagen, Planner: Bei ABSENT: Commissaunex K.-oskin (caste later at 11:45 p.m.) Chairman Egan opened the public hearing on, the petition RE of Wayzata Developers, Inc., for a preliminary pkat for Ponderosa Ponderosas' an approximate 60 acres located west of Dunkirk Lane between 25th and 28th Avenuas North, Planner Bergly summarized the significant details of the project and pointed out necessary revisions. Chairman Egan indite cated he felt Mr. Bergly had done a. good and thorough job of investigation and that he could find little if anything objectionable, Be felt there was quite a bit of improve- ment with regard to the realigning of the southeast leg of Fountain Lane slightly to the east, thus giving better buildable lots. Commissioner Pre"tker askedif it was necessary to have a walkway between Lot 5, Block, 5, and Lot 11 Block 8 at that poin4 of 27th Avenue North. Planner Bergly replied that this walkway provides contixt;Pity from Park A to Park B and indicated that the purpose of these walkways is to provide alternate' paths to children: going to school: and to parks„ Commissioner Roth indicated 'he felt that the distance of 50 feet from back of buildings to the walkway is too narrow for privacy. Chairman Egan stated he would like to refer this matter to the Plat Committee to iron out the number of problems j needing further attention and that the .Plat Committee would meet with .Mr. Bergly. Commissioner Pollock suggested that Chairman Egan appoint Mr, Niles to the Plat Committee, 1. Roger Fazendin spoke from the floor and asked that the Wayzata Developers stay through the discussion on "Fazendin Park" because his thinking was that long walk paths are not good planning and perhaps between the two of them they could work out a solution, Planning Commission Minutes 2 - April 29, 1970' Commissioner Prekker made a motion to refer the matter to the Plat Committee. Lotion by MOTION was seconded Commissioner Pollock. Motion carried by all aye; vote. Chairman Egan opened the public hearing on the p:eti;tion of PE; James Shaughnessy for preliminary plat ;for "Burgundy Burgundy Village," an approximate 22 acres located east of gest Village Medicine Lake Road:, north ofState Highway 55. Planner Bergl.y related significant points of the petition.. Discussion followed, and Commissioner Prekker asked if we required a screening ;from the car wash directly to the south, Chairman Egan replied he didn't; think it was an effective one sightwise. Commissioner Roth said there is an unusual level of noise from the car wash, and: be would suggest some kind, of baffling. Charman Egan replied that the rear of the building itself provides its own baffling. Commissioner Prekker asked what the reason, was for the Exception adjacent to ;Lot 1, and ML. Shaugxanessy replied than they didn't own that. The question was asked whether Lot. 1was also going to be utilized for apartments. Mr. Shaughnessy stated that Lot l would possibly be used in the future for a retail use, Commissioner Pollock questioned alignment. of 12th Avenue ind.: cating this road should be brought up to standard 70' which would make building setback 65' instead of 73' Commi.sS3oaer Pollock 'noted that Lot 4 doesn't meet area requirements, and Mr. Bergly replied that, this problem could be solved by juggling property lines of Lots 3, 4, arid 5. Mr. Shaugh'oessy replied that if he were granted a variance of 10,000 feet on Lot 4 there would be no problem. Mr. Shaughnessy indicated he has dedicated streets for mortgage purposes. Distances between buildir.g varies up to 500'. He also pointed out that when you look at this plat you see very, little parking lot but a tremendous amount of green area. Commissioner Neils- commented that parking is off to one side or end of building in each case which results in cL: cbmstance where occupant living ,in far end of building has a further distance to go to get his car, Mr. Shaughnessy agreed that a Unit A occupant would have to walk about 100' to get to parking lot for his second carr, but he emphasized the fact that each occupants has one parking stall right under the building.. He thon, closed the public hearing. 1n the dis- ussiOn that followed, Mr. Bergly explained that this project is of low density and. that 20 additional., units would be allowed under existing ordinance and under the Community Unit Project, the project would allow an additional 100 units, Commissioner Prekker made a motion to approve preliminary 1IOT. ON plat subject to the following conditions 1) A 70' right-of-way be allowed on 12Th Avenue.. 2) The curvature of 12thAvenue be adjusted per Engineer Hagen` s ~ecot imendations. 3) An easement be authorized , to include parking on. Lot 2 for Lot . 4) A variance be granted for Lot 4, which is below the minimum area requirements for n1,mr1ar of units proposed. 5)Aneryasement for common driveway between Lots 2 and. 4. Commissioner Chapman seconded, the motion. Chairman Egan i 1 indicated: he thought there vas a problem with setback on Lot 5, Unit L, but that this could be taken up under site plan: approval,. Motion was carried by unanimous dote. Mr. Shaughnessy indicated he would bring in ;a landscaping plan and said he planned to put in cul-de-sac right away but that 12th Avenue would bc- quite an investment to put in at this time, and he would like to put 12th in at :the time Unit E is developed. Commissioner' Pollock suggested that could be eliminated from final plat. Roger Fazendin presented his remarks to the effect that the parks are a knotty problem, Ke feels the; Tillageis running into the question al"-' what are the parks galin-g to be .and how are they going to be handled. Re suggested that these two plats, Ponderosa and Fazendin Parke be used as examples, Mr. Fazendin told of a State maintenance yard over in that neighborhood and raid that they Rdn' 't: want any dirt moved on it. He felt the Planning Commission should have the Village tell the State to wove it out, or do something with it, because that is no place for, a, junk pile, Planner Pergly presented the petition of G, :Allen Enter- RE: pry.. p for a conditional use permit in an R-0 district for G. Chairman Egan;indicated to `petitioner that he could look to a fall completion of the study. Discussion opened on a. conditional use permit for Robert F. Rei.ke to operate a marine sales operation on a 40'x Robert 60' lot on the southeast corr.,ar of the Dairy Queen tract E. Reike across from PlVmouth Tillage shopping ceuterron 55. Chairman Egan questioned the petitioner on the parking aspect, and, fir. Reilc.e replied that he does not have a largo volume of people, they generally amble over from the Dairy- Queen. It was brought out than this would 'be a seasonal parmit running from the first of April to the end. of July. Motion was made by Commissioner Chapman to MOTION grant, a conditional use permit. Commissioner June seconded, and the motion rias carried by unanimous vote. Discussion opened on the petition of Zachary Lane Nursery RE: Landsc,"ing for a conditional use permit in an R-0 dis- Zachixty trice for the purpose of erecting a 4'x8" sign on the Lai -ie, Nurc:ery corner of Zachary Lane and County Road 9, Commiss.i.one:, and Pollock stated he felt the use itself was illegal, that Landscaping in an R -O district greenhouses are permitted for growing purposes only, not for retail, sales, Planner Bergly" commented that he had talked with the Nursery, and, they had told him this was not a retail stales operation, that they have the plants there and the machinery to move theca out, Commissioner June indicated he felt plants were being sold there. Commissioner Neils sated he felt the problem wasn't one of traffic but that you have a "non- conforming use" in an R-0 district, and CommissioDer June indicated that what is there is, not" offensive, but thaw things have a way of growing, Com ilssioner Hafner indi- cated that he couldn't understand why the Planning Commission would allow a sign since this would be setting a precedeat, and he feels signs are the ;Host: unsightly thing, in the country, 11.anning Commission 11inutes - 6 - April 29, 197 Commissioner Hafner mooted that the request be detti.ed. A petition was presented by W. C. King, &chiteet, and RE;- Ivan Olson of Van Dusen-for site plan approval for Van Dusen industrial building expansion for Van Dusen,, Inc... Expansion located in the vicinity of Dunkirk Lane, Medina Road, and State. Highway 55. The petitioners were complimented on -screening ofparking areas. Commissioner Prekker made MOTION a. motion for approval, of the site plan with recommendation of r,: moval of the s uth two parking stalls tomotet front yard; setback requirements. Commissioner Chapman .seconded, and the motion was carried by a unanimous, vote. Site plan approval was requested by Richard Cox, repre- RE: senting Minneapolis Industrial Park, for the: industrial Beatrice building for Beatrice Foods Company (John. W. Sexton) Foods (John located on Zinnia Vane: between Fater Tower Circle and. W. Sexton) Industrial Park Boulevard. Commissioner Pollock moved approval of site plan subject to the engineering report MOTION on drainage and including the 5 foot variance on the front side yard and a 10 foot variance on the north side yard. Commissioner Hafner seconded the motion., Engineer Hagen indicated he would like to see grading plans . Motion was carried by unanimous vote. Site plan approval was requested by Richard Cox for the RE: 1Ii.nnea,polis Industrial Paris office building located at MIP Office County Road 6 and Highway 55. The question of drop-off Building traffic on the service drive in front of the building was raised by Planner Bergly. Mr. Cox replied that experience has been that there is 't a lot; of drop-off traffic. Planner Bergly indicated that C e need a foott ancevariance on all sides of p-arking abutting interior property line. The building location is appropriate. He suggested that: appropriate signs should be pint on the side to facilitate traffic movement during peak hours, both at the access point of the frontage road and at the drop-off points, and subject to engineer's approval of grades. Commissioner Roth asked if egress meets Gold, Bond's access on County Road 6, and Planner Bergly replied it didn't appear so. Planning Commission Kinutes 8 April 29, 1970 Mr. Ted Pamperin, resident representing the Wedgewood and °pinewood neighborhoods, presented a petition of those opposed to the road alignmaat because of its bringing the industrial park into the existing single family neighborhood. Residents are agaList rezoning of the area from R- O to 1--1 in the southeastern quadrant of the -requested :area and ask that 600 feed west. , and 670 feet - north not be zoned industrial to protect the residents. Commissioner Pollock replied that the location of the structures could be such as to provide proper space desired by residents. Chairman; Egan summarized discussion by indicating that a group formed of himself) Engineer Hagen, Planner tergly, arse' Commissioner Polltaaci go out in the field: and explore all aspects of the problem and; finally comeup with a workable solution. Commissioner Pollock made a motion MOTION to this effect and also indicated that this group would have the specific intention of making a recommendation to the Commission at their next regular meeting,. Motion was :seconded by Commissioner Prekicer and carried by unanimous: vote Discussion opened on the special use permit for Jerome Begin, to construct a sang tory landfill - south of County RE; Jerome Road 9 and west of Nest Medicine Lake Boulevard and also Begin's on the request to have a. small building on skids to be Sanitary- used as an office for the operation. Chairman Egan Landfill indicated that the Planning Commission has practically tail,ormade the Sanitary Landfill Ordinance around the request of bb:,. Begin for a sanitary landfill and stated` that the ordinance dors call for a conditional use permit The landfill is ready to be operational., and it could provide a.pretty good service to the people in Plymouth who are in need of such a facility. A 30 -day permit could be granted Commissioner Neils asked what the. Planiiing Commission's role should be. on application of this matter. Should not first priority be whether this location is an appropriate place for a sanitary landfill. Chairman Egan replied that this question- was answered a year or so ago in the affi.rma- j tive. Commissioner Neils questioned what stipulation,-, would be involved, and Planner Berg.y replied that it is an engineering concern to make 'this, site worth something when they are through with it, Commissioner Neils replied then we must be concerned with end topography. Engineer Hagen indicated that Mr. Begin had basically matched. up Planning Commission Minutes - 9 April 2.9, 1970 wILth grades on Rockford Road, Commissioner Chapman asked about runoff, .and ringineer Hagen replied thatt this aspect has been examined by PCA and Consulting Engineer onestroo, and it %s felt that drainage is filtered far enough and doesn't run directly overland. Commissioner Chapman made a mot.on granting a conditional MOT ICN use permit for the sanitary landfill, operation subject to the onginee*;'s approval of final grading pians. Commissioner Pollock seconded the motion, and it was carried by a iianimous vote. Commissioner Chapman made a motion` granting approval for an office for the sanitary landfill. Commissioner Neils seconded the motion, and it was carried by a unanimous vote. The next item on the agenda was committee appointments. RE: Dale Pollack was asked to be Chairman of the. Plat Committee Committee and is to be accompanied an that committee by Gerald Neils Appoint_ as Vice Chairman, and John Moth and Fred Hafner, ments Warren Chapman was asked, to be Chairman of the Zoning Committee, to be accompanied by Ron Prekker as Vice Chair- man, and Reginald Kroskin and Marlo ,Tune, Chairman Egan suggested hggthatatcommitteechairmencheck with John Bergly for items coming up for end, of May meeting and then get together with their, respective committees for study before .the ,meeting. Commissioner Neils made a, motion that the Planning Comm:i.ss- RE; ion hold two meetings a month --on the first and third Wed- Planning nesdays of the month. Commissioner June seconded the Commission notion, and it was carried by unanimous vote; Meetings Engineer Ragext raised the question of approving a tempos- RE: ary building requested by DeVac between the one just DeVa.c approved and their existing: building. A short disctis`sion Temporary ensued on whether a metal building is allowable, and Building Chairman Egan indicated it was too late in the everting to take this up in the detail necessary. He suggested it betabled until the nett meeting and directed it to be put on the May 13th agenda Commissioner Trekker renominated Dale Pollock for the RE; position of Vice Chairman of the Planning Commission.
