A regular meeting of the Planning Commission was called to order by
Chairman Rg;an at 8.-nO P.N. on March 25, 1970,
PRESMIT: Commissioners Chapman:, Hafner, Kroskin, Pollock, Prekker,
Neils,, Roth, planner bergly aTid Engineer Hagen
lotion by Cammissioner Pollock, second by Commissioner Chapman to
approve Vhe minutes of the Special Planning Commission Meeting
of Telarch ll, 1970 with the following changes.
Commissioner Prekker's name was omitted as being present on the
Special Plannirig Commission Minutes of %Z rch 11, 197n.
On page 1, ?nd paragraph, last sentence "Discussion on Mr. Dergly's
plan" etc, .should be deleted and the following added: `Gomhiissioner
Pollock vecoirmended that the comprehensive plan remain unchanged".
0:a page, 2, 3rd paragraph, 4th line, Commissioner Neils was shown in
favor of the mw:lon. This was in error and his name should be
removed. The following sentence should be added to that paragraph,
Commissioner Neill abstained from voting".
Motion passed by aU Commissioners present voting aye.
PUBLIC HEARUNGS
Chairman Egan opened ;a public hearing on petition of Robert Pritchard Re. Rezoning
to change the zoning from R -G Open :Resi.denco District to R-3 Mfultiple Robert Pritchard
Family ''Residence District (Toimhouse) located between 54th Avenue
North and the Soca Line tracks immediatelywest r_.f Zachary Lane.

4r. Pritchard stated the total site area is 10.24 acres. The proposed

minimum of 45 foot front yard setback shown --- 35 foot minimum allowed),

Maimzan Egan then asked if anyone xwas against the rezoning,.

being given by the park hoard for the proposed 7 units per acre of
development proposed. lie w, -ked that if the Planning Commission would
be looking at surrounding 'land uses in malting their decision, Ile was
answered: In the affirmative and it was pointed out that:_ a comprehensive

Commissioner Pollock .stated the proposal does not conform to comprehensive.'

areas that remains to be ret:*iewed for the comprehensive plan

Commissioner Chapman made a motion that the request be denied, seconded
by Pol.l.oclt Chairman. Egan stato-4 this particular, notion would be
consistent with an action that the Commission took a few months ugp
with utilities 2-5 years away. Motion carried by all aye vote.
Chairman Egan presented tha request of Mr. Alvin WI. Schmidt for a Ile: Cond. Use Permit
Condition-al fuse Permit to have retail sales of garden and l.aim Alvin W. Schcuidt
equipment within an existing conditional use business -- "Feacon
Heights Auto Sales" in a Service `business District, located north
of highway 55 near West Medi.ci.ne Lake Drive. Planner Iiergl.y pointed
out the area in question; He stated the specific use recitiested is
not In the hist of uses allowed by condiL omal use permit in ine Hai
District. The determinatiau would have to bn made whether the nature
of the proposed use would quality fo item number 13 under Subdivision
3, Section 13 --- "Other business activities not specifically named of
the same general character' as listed in Subdivision 2 of this :Section".
Adequate parking Mould be required on used car lot. engineer Dagen
Mated that the previously i.s qued conditional use permit allowed ki=;
petitioner to display 25 vehicles on a used car tat at anv one time.

Chairmar man presented the request for a conditional use permit for Re., Cond., Use Permit
eVan for the purpose of conducting a manufacturing use in, an 1-1 DeVac Inc.
District located north of tttghvay 55 at Pilgrim Lane. 'Planner Pertly
mentioned that on november 19, 1969 the Planning Commission approva'd
a site plan for expaading their present building.
Commissioner Roth suggested finding out whether or not the Commission
was dealing with I or two lots, If 2 lots are involved, the variances
Would have to be granted for the side yard: setrbact to the districT
ensued on complications that might arise if either the front lot or the
rear lot were sold,
Commissioner Chapman made a motwion, seconded by Commissioner Pollock to
approve conditional use permit and recommend granting of a variance
to place a building on the lot ling without a public street frontage
subject to tine following 4 conditions;
1., The entrance drives to ti+e parking lot Gaffof the frontage road
sicou.ld be reduced to 2q and 30 foot curb openings,
2. All parking must be moved behind the 50' ,Front vard setback line,
3. Parking setback from side lot lines should :he maintained as 15',
4. The steep slope on the westerly Side of the property adjacent to

Commissioner Kroskin made a suggestion that they, refer to Council
if these two buildings -ever leave tzce ownership of one party. Upon
