HomeMy WebLinkAboutCity Council Ordinance 2003-06CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 2003 -06 AN ORDINANCE AMENDING THE TEXT OF CHAPTER 21 OF THE PLYMOUTH CITY CODE, ENTITLED THE PLYMOUTH ZONING ORDINANCE (2003007) THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: SECTION 1. Amendments. The text of Chapter 21 of the Plymouth City Code is hereby amended as follows: A. SECTION 21005.02 (RULES AND DEFINITIONS— DEFINITONS) IS HEREBY AMENDED BY ADDING THE FOLLOWING DEFINITION: Menu Board: A sign installed in a drive - through facility listing the products available for purchase by drive - through customers. B. SECTION 21155 OF THE PLYMOUTH CITY CODE (SIGN REGULATIONS) IS HEREBY AMENDED AS FOLLOWS: Section 21155.03 District Requirements Subd. 4. Other Commercial Districts. Signs are accessory to permitted, interim, and conditional uses in the C -1, C -2, C -3, C -4, CC, C -5 and B -C Districts. Only the following signs are permitted in these districts, unless otherwise specifically provided in this section: (Amended by Ord. No. 2000 -09, 03121100) (a) For City Center District regulations, also refer to Section 21475.17, Subd. 6. Ordinance No. 2003 -06 File No. 2003007 Page 2 (b) All signs permitted in Section 21155.03, Subd. 1. of this Section. (c) Business Signs. (1) Allowable uses and business establishments, including individual business and tenants in multi -tenant commercial buildings, may have wall business signage provided such signage not extend more than eighteen (18) inches from the building, except that such signage may extend from the face of the roof over a covered walk, or from a marquee, provided the signage does not extend above the roof or parapet of said building. Wall business signage shall be permitted on one wall; however, lots with frontage on two or more streets may have signage on one wall per street frontage. Such signage shall not exceed ten (10) percent of the area of the wall to which the signage is attached. All such signs shall be reviewed by the building ownership or management who shall provide a written endorsement at the time application is made for the sign permit. (2) Canopies shall be considered to be an integral part of the structure to which they are accessory. Signs may be attached to a canopy, but such structures shall not be considered as part of the wall area, and thus shall not warrant additional sign area. Canopy signage shall be deducted from the permitted wall signage area. Canopies for motor vehicle fuel sales that do not include a convenience market on the lot shall be permitted separate signage. Such signage may occur on all faces of the canopy and shall not exceed twenty -four (24) square feet in surface area or twenty (20) percent of the face of the canopy to which the signs are attached, whichever is greater. No. 2001 -25, 08114101) (3) One (1) freestanding business sign not to exceed one hundred (100) square feet in surface area or thirty-six (36) feet in height, and set back at least ten (10) feet from lot lines. (Amended by Ord. No. 2000 -06, 02129100) (4) Two (2) One (1) menu boards per restaurant use are Is- allowed with a permitted drive- through facility, subject to the following conditions: (a) The main menu board Soeh sigrxage shall not exceed thirty-six (36) square feet in surface area or eight (8) feet in height from grade to the top of the sign. (b) A second smaller menu board is permitted to be located prior to the main menu board and adjacent to the drive - through aisle within view of drive- through customers. If a second menu board is used, the main menu board shall be reduced to thirty- Ordinance No. 2003 -06 File No. 2003007 Page 3 two (32) square feet. The smaller menu board shall not exceed six (6) square feet in surface area or four (4) feet in height. This menu board shall provide a selection of menu items and shall not be used primarily for graphics or advertising. (c) Menu board gush signage is permitted in addition to other permitted signage. (d) The menu boards shall be the same style and color, single -sided and oriented in such a manner so that the signs provide information to the patrons using the drive- through facility only. (e) Product advertising shall not be attached to any menu board in excess of the maximum size allowed. (f) Approvals of a second menu board will be granted only upon the elimination of all existing illegal signage. (Amended by Ord. No. 99 -5, 01119199) SECTION 2. Effective Date.
