HomeMy WebLinkAboutCity Council Ordinance 2005-17CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 2005-17 AN INTERIM ORDINANCE TEMPORARILY PROHIBITING THE ISSUANCE OF SUBDIVISION APPROVAL AND ZONING APPROVALS IN A DESIGNATED AREA SOUTH OF TRUNK HIGHWAY 55 ON BOTH SIDES OF COTTONWOOD LANE THE CITY COUNCIL OF PLYMOUTH ORDAINS: SECTION 1. DEFINITIONS: The following terms when used in this ordinance shall mean: OFFICIAL Ordinances and regulations which control physical development, CONTROLS: including ordinances establishing zoning, subdivision controls, site plan regulations, sanitary codes, building codes, and official maps. STUDY AREA: The parcels that are zoned RSF-1 and located on both sides of the dead- end section of Cottonwood Lane south of Trunk Highway 55 as shown on the attached map dated July 1, 2005, which is incorporated herein by this reference. SUBDIVISION: The separation of an area, parcel, or tract of land under single ownership into two or more parcels, tracts, lots, or long-term leasehold interests where the division necessitates the creation of streets, roads, or alleys for residential, commercial, industrial, or other use or any combination thereof, except for those separations: A. Where all the resulting parcels, tracts, lots or interests will be 20 acres or larger in size and 500 feet in width for residential uses and five acres or larger in size for commercial and industrial uses; B. Creating cemetery lots; C. Resulting from court orders or the adjustment of a lot line by the relocation of a common boundary. ZONING Rezoning, land use guide plan changes, conditional use permits, interim APPROVALS: use permits, variances, site plan approval, planned unit development approval and building permits for new structures. SECTION 2. INTENT: It is the intent of this ordinance to allow the City of Plymouth time to complete an in-depth study concerning adoption of a comprehensive revision to the City's Comprehensive Plan for the study area and official controls implementing the comprehensive plan, and in the interim to protect the planning process and the health, safety, and welfare of the citizens of the community. SECTION 3. TEMPORARY PROHIBITION: Pending the completion of the above reference study and the adoption of appropriate official controls, no building permits, pre -application sketch reviews, subdivisions or zoning approvals shall be processed or approved and no application for such approvals shall be accepted for property in the study area. SECTION 4. EXEMPTIONS: The statutory exemptions to this ordinance set forth in Minnesota Statutes § 462.355, Subd. 4 are incorporated herein by reference. SECTION 5. EFFECTIVE DATE: This ordinance shall take effect immediately upon its approval and shall remain in effect until the date of the adoption of the comprehensive plan amendment and official controls contemplated hereunder or July 12, 2006, whichever occurs first.
