RESOLUTION No. 2013-015
A RESOLUTION AUTHORIZING THE VACATION OF
A PORTION OF A PLATTED, DRAINAGE AND UTILITY EASEMENT
WITHIN OUTLOT A, TERRA VISTA ADDITION AND TWO TEMPORARY
CUL-DE-SAC EASEMENTS ALSO WITHIN TERRA VISTA ADDITION
WHEREAS, a public hearing with respect to said vacations was scheduled for January 8,
2013, in accordance with Minnesota Statutes 412.851 and City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of October 9, 2012; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the City Council did hold a public hearing on January 8, 2013, to inform any
and all interested parties relevant to the vacation of a portion of a platted drainage and utility
easement within Outlot A, Terra Vista Addition and two temporary cul-de-sac easements also
within Terra Vista Addition; and
WHEREAS, it was determined by the City Council that said easements are not needed
for public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of a platted,
drainage and utility easement within Outlot A, Terra Vista Addition and two temporary cul-de-
sac easements also within Terra Vista Addition, be vacated, described as follows:
Drainage and Utility Easement
That part of the drainage and utility easement over, under and across that part of Outlot
A, TERRA VISTA, according to the recorded plat thereof, Hennepin County, Minnesota,
Described as follows:
Commencing at the most northeast corner of said Outlot A; thence on an assumed
bearing of South 00 degrees 02 minutes 02 seconds West, along the east line of
said Outlot A a distance of 485.75 feet to the point of beginning of the area to be
vacated; thence continuing on said east line a distance of 364.85 feet; thence on a
bearing of West a distance of 85.00 feet; thence North 10 degrees 03 minutes 23
seconds East a distance of 47.62 feet; thence North 04 degrees 29 minutes 38
seconds East a distance of 71.28 feet; thence North 30 degrees 17 minutes 27
seconds West a distance of 103.00 feet; thence North 26 degrees 17 minutes 34
seconds West a distance of 103.86 feet; thence North 20 degrees 12 minutes 23
seconds West a distance of 79.84 feet; thence North 10 degrees 09 minutes 00
seconds East a distance of 66.90 feet; thence South 58 degrees 14 minutes 04
seconds East a distance of 61.34 feet; thence South 80 degrees 20 minutes 20
seconds East a distance of 55.83 feet; thence South 66 degrees 14 minutes 36
seconds East a distance of 85.08 feet to the point of beginning.
Zanzibar Lane Temporary Cul -De -Sac Easement
Described as follows:
Lying over, under and across that part of Lot 24, Block 3, and Lot 1, Block 4,
TERRA VISTA, according to the recorded plat thereof, Hennepin County,
Minnesota, which lies within the circumference of a circle having a radius of 37
feet. The center of said circle is described as commencing at the northeast corner
of said Lot 24, Block 3; thence on an assumed bearing of North 70 degrees 26
minutes 22 seconds East, along a northwesterly line of said TERRA VISTA
which is also the southwesterly extension of the northwesterly line of said Block
4, a distance of 26.15 feet; thence southerly a distance of 54.15 feet along a non-
tangential curve concave to the East, having a radius of 225.00 feet, a central
angle of 13 degrees, 47 minutes 17 seconds, and a cord which bears South 08
degrees 30 minutes 01 seconds East to the center of said circle.
59th Avenue Temporary Cul -De -Sac Easement
Described as follows:
Lying over, under and across that part of Lots 3 and 4, Block 1, and Lot 1, Block
7, TERRA VISTA, according to the recorded plat thereof, Hennepin County,
Minnesota, which lies within the circumference of a circle having a radius of 37
feet. The center of said circle is described as commencing at the northwest corner
of said Lot 1, Block 7; thence on an assumed bearing of North 00 degrees 17
minutes 54 seconds East, along a West line of said TERRA VISTA, a distance of
26.16 feet; thence South 72 degrees 35 minutes 58 seconds East, a distance of
43.74 feet to the center of said circle.
FURTHER, that said vacations shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary
and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or
thereunder, to continue maintaining the same or to enter upon such way or portion thereof
vacated to maintain, repair, replace, remove, or otherwise attend thereof.
