HomeMy WebLinkAboutCity Council Resolution 2013-014CITY OF PLYMOUTH RESOLUTION No. 2013-014 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO EXCEED 50 PERCENT OFFICE USE IN THE 1-2, GENERAL INDUSTRIAL ZONING DISTRICT FOR PROPERTY LOCATED AT 1300516 TH AVENUE NORTH (2012100) WHEREAS, Mohagen Hanson Architectural Group has requested approval of a conditional use permit for the site legally described as follows: Lot 5, Block A, Plymouth Orchards, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mohagen Hanson Architectural Group for a conditional use permit to exceed 50 percent office use in the existing industrial building located at 13005 16t1' Avenue North, subject to the following conditions: 1. A conditional use permit is approved to allow 60 percent of the building (15,537 square feet) to be used for office use, in accordance with the application and plans received by the city on November 27, 2012, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. 3. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 4. Prior to construction of tenant improvements in the building, the applicant must obtain separate approval of a building permit. 5. Standard Conditions: a. Any signage shall comply with the city's sign regulations. b. All waste and waste containers shall be stored within approved designated areas. c. All parking shall be off-street in designated areas which comply with the zoning ordinance. d. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. e. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
