HomeMy WebLinkAboutCity Council Resolution 2015-068 City of Plymouth Resolution No. 2015-068 A Resolution Approving a Final Plat and Development Contract for “Vicksburg Ridge” for property located at 4420 Vicksburg Lane (2014091-F) WHEREAS, Vicksburg 5, LLC has requested approval of a final plat for 11 single-family lots and one outlot on roughly ten acres located at 4420 Vicksburg Lane; and WHEREAS, the property is presently legally described as follows: The South 331 feet of the North 662 feet of Government Lot 1, Section 16, Township 118 North, Range 22 West of the 5th Principal Meridian, said 331 feet measured at right angles with the North line of said Government Lot 1, according to the U.S Government Survey thereof, Hennepin County, Minnesota. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Vicksburg 5, LLC for a final plat for Vicksburg Ridge; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: The final plat for Vicksburg Ridge is approved in accordance with the plans received by the city on January 20, 2015, except as may be amended by this resolution. Prior to commencement of grading operations, the developer shall install and request inspection of tree preservation fencing and silt fencing. Prior to recording the final plat, the developer shall: Remove existing structures from the site. Demolition permits are required for removal of existing structures containing over 120 square feet. Provide an easement for the temporary cul-de-sac turn-around. Provide a separate ten-foot wide trail easement along the west side of those properties that abut Vicksburg Lane. Execute the development contract and provide the related financial guarantees and fees. Receive city approval of final construction plans. Dedicate and convey Outlot A to the city by warranty deed, free and clear of any and all encumbrances. Pay the required park dedication fee, with credit given for the upland area of Outlot A. Prior to issuance of building permits for lots abutting wetlands, permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. Prior to issuance of building permits for lots that abut Outlot A, the developer shall install parkland signs/monuments to delineate the city property, in locations as required by the City Parks Department. The developer shall notify potential buyers about future roadway extensions and about the future street improvement projects for Vicksburg Lane. The developer shall post a sign near the east (temporary) terminus of 43rd Avenue within the development to notify passersby that the street will be extended in the future. The street and utilities shall be constructed to the north plat boundary. The homeowner’s association documents shall address: a) responsibilities for maintenance and repair of developer-installed retaining walls, subdivision signage, wetland buffers, buffer monuments, sidewalks, and any other similar or common features, and b) prohibition on structures and the clearing of native vegetation from the wetland buffers. Construction access to Vicksburg Lane may be limited or restricted during the Vicksburg Lane reconstruction project. All lots shall comply with the maximum impervious surface coverage regulations specified in section 21665 of the zoning ordinance. Secondary access for the development is hereby waived. Secondary access (via Terraceview Lane to the north) would be provided if and when the parcel to the north is subdivided in the future. Standard Conditions: Except as otherwise may be allowed for model homes, no building permits shall be issued until the final plat is recorded with Hennepin County and streets and utilities are installed. Development standards and setbacks for this plat shall comply with the RSF-2 zoning standards. No variances are granted or implied. Any signage shall require separate permits and shall comply with the city’s sign regulations. No trees shall be planted in the boulevard. The sidewalk shall be installed at the same time the street is installed. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. Compliance with the city’s tree preservation regulations. Removal of all hazardous trees at the owner's expense. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
