Resolution Approving Acquisition of Permanent and
Temporary Easement for Street, Drainage,
Utility and Sidewalk Purposes
WHEREAS, the City
requires permanent and temporary construction easements for public street, drainage, utility and sidewalk in connection with the City’s Vicksburg Lane Improvement Project; and
WHEREAS,
Glenn LaBorde, Jr. and Harriet G. LaBorde, husband and wife, are fee owners (“Owners”) of real property located within the City of Plymouth legally described as follows:
The North 331
feet of Government Lot 1, and including accretions thereto, subject to a road right of way over the Westerly 33 feet thereof, in Section 16, Township 118, Range 22, said 331 feet measured
at right angles with the North line of said Government Lot 1, according to the recorded plat thereof on file and of record in the office of the County Recorder in and for Hennepin County,
Minnesota, (the “LaBorde Property”); and
WHEREAS, Owners have agreed to grant the City a permanent easement for street, drainage, utility and sidewalk purposes and a temporary construction
easement over a portion of the LaBorde Property legally described on the attached Exhibit “A” (the “Easement Property”); and
WHEREAS, the City has agreed to pay the Owners $18,700.00
as compensation for the permanent and temporary easements and $50.00 as reimbursement for the processing fee for the Mortgage Holder Consent to Easement (“Acquisition Price”); and
WHEREAS,
Owners have executed a Grant of Permanent and Temporary Easement in the form attached hereto for the purpose of granting the Easement Property to the City and the Grant of Permanent
and Temporary Easement will be recorded upon adoption of this Resolution at the sole expense of the City.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the acquisition of easement property from the owners and payment of the acquisition price is hereby approved.

EASEMENT DESCRIPTIONS
A permanent easement for street, drainage, utility and sidewalk purposes over,
under, across and through the East 10 feet of the West 43 feet of the above described parcel.
AND
A temporary easement for construction purposes over, under, across and through the
East 20 feet of the West 53 feet of the South 20 feet of the above described parcel.
AND
A temporary easement for construction purposes over, under, across and through the East 10
feet of the West 63 feet of the South 50 feet of the North 172 feet of the above described parcel.
Said temporary construction easements to commence on April 15, 2015 and expire on
June 1, 2016.
