RESOLUTION No. 2012-306
A RESOLUTION AUTHORIZING THE VACATION OF
A PORTION OF A PLATTED, DRAINAGE AND UTILITY EASEMENT WITHIN
OUTLOT A, TAYLOR CREEK ADDITION
WHEREAS, a public hearing with respect to said vacation was scheduled for October
9, 2012 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06;
and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of October 9, 2012; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified
by mail; and
WHEREAS, the City Council did hold a public hearing on October 9, 2012 to inform
any and all interested parties relevant to the vacation of a portion of a platted drainage and
utility easement within Outlot A, Taylor Creek Addition; and
WHEREAS, it was determined by the City Council that said easement is not needed
for public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA: That following portion of a platted, drainage
and utility easement within Outlot A, Taylor Creek Addition, be vacated, described as
follows:
Commencing at the southeast corner of Outlot A; thence on an assumed bearing of
North 00 degrees 08 minutes 49 seconds East along the east line of said Outlot A a
distance of 291.80 feet to the point of beginning of that part of the easement to be
vacated; thence continuing on the last described line a distance of 94.41 feet; thence
westerly a distance of 21.73 feet along a non-tangential curve, concave to the south,
having a radius of 177.50 feet a central angle of 07 degrees 00minutes 52 seconds
and a cord of 21.72 feet which bears North 74 degrees 26 minutes 16 seconds West;
thence South 42 degrees 27 minutes 06 seconds West a distance of 45.93 feet; thence
South 36 degrees 32 minutes 29 seconds West a distance of 54.81 feet; thence South
23 degrees 35 minutes 26 seconds West a distance of 13.41 feet; thence South 83
degrees 37 minutes 36 seconds East a distance of 90.24 feet to the point of beginning.
FURTHER, that said vacation shall not affect the authority of any person, corporation,
or municipality owning or controlling the electric or telephone poles and lines, gas lines,
sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas
thereon or thereunder, to continue maintaining the same or to enter upon such way or portion
thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
