RESOLUTION NO. 2012-290
A RESOLUTION AUTHORIZING A FIRST AMENDMENT TO THE DEVELOPMENT CONTRACT
FOR ELM CREEK HIGHLANDS EAST 3RD ADDITION (2012055)
WHEREAS, the City of Plymouth approved a final plat and development contract for
Elm Creek Highlands East _3 Addition for land located north of Schmidt Lake Road and Jewel
Lane; and,
WHEREAS, the city staff has prepared revisions to paragraph 27 of said development
contract; and,
WHEREAS, in accordance with the revised development contract Pulte Homes has
requested to pave and constrict the related curb for Kimberly Lane on Outlot A, Elm Creek
Highlands East -1 Addition; and,
WHEREAS, the affected property is legally described as follows:
Outlot A, Elm Creek Highlands East -1 Addition, according to the recorded plat thereof,
Hennepin County Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by Pulte Homes to amend the development contract for Elm Creek
Highlands East -1 Addition.
FURTHER, that the development contract amendment for said plat be approved, and that
upon prior execution of the development contract amendment by the developer, the Mayor and
City Manager be authorized to execute the development contract amendment on behalf of the
city; and
FURTHER, that the city staff record the amendment to the development contract with
Hennepin County; and
FURTHER, that prior to paving and constricting the related curb for Kimberly Lane in
outlot A, the city shall review and approve a final street plan.
