ORDINANCE N0. 2011-23
AN ORDINANCE AMENDING CHAPTER 5 OF THE
PLYMOUTH CITY CODE (2011012)
THE CITY OF PLYMOUTH ORDAINS:
SECTION 1. Amendment. Section 512.03, Subd. 6 (a) (8) of the Plymouth City Code
(FINAL PLAT PROCEDURE—APPLICATION REQUIREMENTS) is amended as follows:

SECTION 2. Amendment. Section 516.01 of the Plymouth City Code (ADMINISTRATION
- VARIANCES—PURPOSE) is amended as follows:
516.01. Purpose. The purpose of this section is to provide for variations from the literal
provisions of this Chapter in instances where stw„t eaf ..,.eme t would ,.ause an unusual hardship

intent of this Chaptef exists upon the land.
SECTION 3. Amendment. Section 516.03 of the Plymouth City Code (ADMINISTRATION
- VARIANCES—BOARD OF ADJUSTMENTS AND APPEALS) is amended as follows:
516.03. Board of Adjustments and Appeals. The City Council shall be designate act
as the Board of Adjustments and Appeals. References to the "Council" hereafter in this section
shall mean the City Council acting in its capacity as the Board of Adjustment and Appeals.

SECTION 4. Amendment. Section 516.05 of the Plymouth City Code (ADMINISTRATION
– VARIANCES—REVIEW CRITERIA) is amended as follows:
516.05. Review Criteria.
Subd. 1. The Council shall not approve a variance unless they find that the following
criteria, as applicable, have been met:
(a) The variance, and its resulting construction or project, would be in keeping with
the spirit and intent of this Chapter.
(ab) The ,,...,, ting of ariance would alleviate an unusual hardship existing upon
the land related to the such as physical surroundings, shape, or topographical conditions
of the speeifie par -eel of land . Unusual hardship includes, but is not limited to,
inadequate access to direct sunlight for solar energy systems.
(bc) The gnmtiag of ariance, and its resulting construction or project, would not
be detrimental to the public welfare or injurious to other nearby properties.
(ed) The bested -variance requested is the minimum action required to alleviate the
hardship.
SECTION 5. Amendment. Section 520.09, Subd. 1 of the Plymouth City Code
(ADMINISTRATION – APPEALS—PROCEDURE) is amended as follows:
Subd. 1. The property owner or their agent shall file with the Zoning Administrator a
notice of appeal stating the specific grounds upon which the appeal is made. Said appheatie

SECTION 6. Effective Date. This Ordinance shall be in full force and effect upon its
passage.
