RESOLUTION No. 2015-021
A RESOLUTION APPROVING AMENDMENTS TO THE FINAL PLAT AND DEVELOPMENT
CONTRACT FOR "FRETHAM TWENTY THIRD ADDITION" (2014035F)
WHEREAS, Lake West Development, LLC. requested approval to amend the final plat and
development contract for Fretham Twenty Third addition at 18025 County Road 6 and legally described
as follows:
All that part of Government Lot 4, Section 30, Township 118, Range 22, lying South of
County Road No. 6, EXCEPT that part of Government Lot 4, Section 30, Township 118,
Range 22, described as follows:
Commencing at the Southeast corner of said Government Lot 4; thence North along the
East line thereof a distance of 573.5 feet; thence Westerly deflecting to the left 83
degrees 27 minutes, a distance of 480.25 feet; thence Southwesterly deflecting to the
left 77 degrees, a distance of 76.35 feet; thence Northwesterly deflecting to the right 95
degrees 52 minutes, a distance of 151.01 feet; thence Northerly deflecting to the right
66 degrees 07 minutes 380.74 feet more or less to the Southerly line of County Road No.
6, as the same is now laid out and constructed; thence Southwesterly along the
Southerly line of said County Road No. 6 to its intersection with the West line of said
Government Lot 4; thence South along the West line of said Government Lot 4 to the
Southwest corner thereof; thence East along the South line of said Government Lot 4 to
the point of beginning.
ALSO EXCEPT: That part of Government Lot 4, Section 30, Township 118, Range 22,
described as follows:
Commencing at a point on the East line of said Government Lot 4, distant 989.7 feet
North of the Southeast corner thereof; thence Westerly, deflecting to the left 98
degrees 35 minutes a distance of 503.1 feet; thence deflecting to the right 71 degrees
and 21 minutes a distance of 113.2 feet, more or less, to the South line of County Road
No. 6; thence Easterly along the South line of said County Road No. 6 to its intersection
with the East line of said Government Lot 4; thence South along the East line thereof to
the point of beginning; and
WHEREAS, the City Council approved resolution 2014-344 and the development contract covering
the improvements related to said plat and those documents require sidewalk, prohibit recording the plat
until the structures on the site are removed and contain no authorization to execute a maintenance
agreement for a detention basin.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lake West Development
LLC. to amend the final plat and development contract for Fretham Twenty Third Addition and authorize

the mayor and city manager to execute the First Amendment to Development Contract on behalf of the
city, subject to the conditions below; and
FURTHER, that city staff record the First Amendment to Development Contract with Hennepin County.
1. The final plat approved by Resolution 2014-344 is hereby amended to waive the requirement for
a sidewalk on one side of Queensland Lane based on the limited number of homes in the
subdivision.
2. The final plat approved by Resolution 2014-344 is hereby amended to allow the plat to be
recorded prior to removing the structures from the site, except as may be amended by this
resolution.
3. Within 30 days after the final plat is filed and recorded with Hennepin County and before
commencing grading and before any building permits are issued for new construction, the
existing structures must be removed from the site. Demolition permits are required.
4. The mayor and city manager are hereby authorized to execute a maintenance agreement for the
detention basin.
5. All other conditions in Resolution 2014-344 shall remain in effect.
6. Subsequent phases or expansions are subject to required reviews and approvals per ordinance
provisions.
7. This approval shall expire with the expiration of resolution 2014-344 subject to the same
provisions in city code.
