HomeMy WebLinkAboutCity Council Ordinance 2007-25CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 2007-25 AN ORDINANCE AMENDING CHAPTER 21 (ZONING ORDINANCE) OF THE CITY CODE TO CLASSIFY CERTAIN LAND LOCATED NEAR THE SOUTHEAST CORNER OF THE INTERSECTION OF COUNTY ROAD 47 AND JUNEAU LANE (2007066) THE CITY OF PLYMOUTH ORDAINS: Section 1. Amendment of City Code. Chapter 21 of the City Code of the City of Plymouth, Minnesota, is hereby amended by changing the classification on the City of Plymouth Zoning Map from FRD (Future Restricted Development) to PUD for property legally described as follows: That part of Government Lot 1 and that part of the Southeast Quarter of the Northeast Quarter both in Section 4, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Beginning at the southwest corner of said Southeast Quarter of the Northeast Quarter; thence South 00 degrees 08 minutes 03 seconds West, assumed bearing along the westerly line of said Government Lot 1 a distance of 600.00 feet to the south line of the North 600.00 feet of said Government Lot 1; thence South 89 degrees 42 minutes 28 seconds East, along said south line a distance of 1168.52 feet; thence North 00 degrees 00 minutes 08 seconds East, a distance of 348.74 feet; thence northwesterly along a non- tangential curve concave to the southwest having a central angle of 53 degrees 54 minutes 26 seconds, a radius of 453.04 feet and an arc distance of 426.24 feet, the chord of said curve bears North 27 degrees 17 minutes 27 seconds West; thence North 54 degrees 14 minutes 43 seconds West, not tangent to said curve a distance of 38.22 feet; thence northerly along a tangential curve concave to the northeast having a central angle of 43 degrees 21 minutes 17 seconds, a radius of 455.00 feet and an arc distance of 344.29 feet; thence North 10 degrees 53 minutes 26 seconds West, tangent to said curve a distance of 186.71 feet; thence northerly along a tangential curve concave to the east having a central angle of 19 degrees 32 minutes 03 seconds, a radius of 455.00 feet and an arc distance of 155.13 feet; thence North 08 degrees 38 minutes 37 seconds East, tangent to said curve a distance of 170.57 feet; thence northerly along a tangential curve concave to the east having a central angle of 5 degrees 56 minutes 59 seconds, a radius of 1000.00 feet and an arc distance of 103.84 feet; thence northerly along a tangential reverse curve concave to the west having a central angle of 23 degrees 32 minutes 23 seconds, a radius of 299.50 feet and an arc distance of 123.05 feet; thence North 08 degrees 56 minutes 47 seconds West, not tangent to said curve a distance of 46.60 feet to the southerly right of way line Ordinance 2007-25 2007066 Page 2 of Hennepin County Highway No. 47; thence South 81 degrees 03 minutes 38 seconds West, along said southerly line a distance of 308.61 feet; thence westerly along a tangential curve and along said southerly line concave to the north having a central angle of 2 degrees 54 minutes 03 seconds, a radius of 991.18 feet and an arc distance of 50.18 feet; thence North 00 degrees 18 minutes 55 seconds East, not tangent to said curve a distance of 33.21 feet to the centerline of said Hennepin County Highway No. 47; thence westerly along a non-tangential curve and along said centerline concave to the north having a central angle of 11 degrees 22 minutes 53 seconds, a radius of 958.18 feet and an arc distance of 190.34 feet, the chord of said curve bears South 89 degrees 25 minutes 55 seconds West; thence South 00 degrees 18 minutes 55 seconds West not tangent to said curve, a distance of 33.11 feet to said southerly right of way line of Hennepin County Highway No. 47; thence westerly along a non-tangential curve and along said southerly line, concave to the north having a central angle of 2 degrees 36 minutes 24 seconds, a radius of 991.18 feet and an arc distance of 45.09 feet, the chord of said curve bears North 83 degrees 44 minutes 04 seconds West; thence North 82 degrees 25 minutes 52 seconds West, along said southerly line and tangent to said curve a distance of 179.59 feet to the west line of said Southeast Quarter of the Northeast Quarter; thence South 00 degrees 18 minutes 55 seconds West along said west line a distance of 1161.74 feet to the point of beginning. Except for the following described parcel: the south 75.00 feet of the north 600 feet of Government Lot 1, Section 4, Township 118, Range 22, Hennepin County Minnesota, except the east 150.00 feet thereof Section 2. Amendment of City Code. Ordinance 2007-25 2007066 Page 4 Section 3. Amendment of City Code. Chapter 21 of the City Code of the City of Plymouth, Minnesota, adopted December 18, 1996 as amended, is hereby amended to add Section 21655.41 — Trillium Woods PUD, as follows: 21655.42 TRILLIUM WOODS PUD: Subd. 1. Legal Description. This PUD is currently legally described as referenced in Resolution 2007-441 on file in the Office of the Zoning Administrator under File 2007066. Subd. 2. Incorporated herein by reference are the Trillium Woods PUD plans received by the City on August 1 and 28, 2007, except as may be amended by City Council Resolution 2007-441, on file in the Office of the Zoning Administrator under File 2007066. Subd. 3. Allowable Uses. a. The allowable uses on Block 1, Lot 1 (14- and 16 -unit structures) and Block 3, Lot 1 (one -level townhouses) are any permitted or accessory uses allowed in the RMF -4 district. b. The allowable uses on Block 2 (a 16 -unit structure and the main apartment building) are any permitted or accessory uses allowed in the RMF -4 zoning district plus skilled nursing care center, assisted living dwellings and assisted living dwellings with dementia care. Additional accessory uses may include private facilities and services directed toward the residents of Trillium Woods necessary to support the residential units, including, but not limited to, private wellness or fitness facilities, convenience food or retail sales, barber/hair salon, dining facilities, auditoriums, administrative offices, etc. All of the uses listed above shall be considered "permitted" uses in the PUD, provided they comply with all the development standards and conditions approved by City Council Resolution 2007-441, on file in the Office of the Zoning Administrator under File 2007066. Subd. 4. Development Standards. Development standards shall be as approved on the PUD General Plan approved by City Council Resolution 2007-441, on file in the Office of the Zoning Administrator under File 2007066. Section 4.
