HomeMy WebLinkAboutCity Council Resolution 2014-386CITY OF PLYMOUTH RESOLUTION No. 2014-386 A RESOLUTION ACCEPTING STREETS FOR CONTINUAL MAINTENANCE FOR THE WILLOWS SECOND ADDITION (201 1003) WHEREAS, in accordance with the development contract dated February 22, 2011, Pulte Homes of Minnesota, LLC, developer of The Willows Second Addition (2011003), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and WHEREAS, the developer has requested a reduction of the required financial guarantee to reflect the completed work. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the financial guarantee requirements are reduced as follows: Tar Street Construction Sanitary Sewer Watermain Storm Sewer System Street & Traffic Control Signs Sidewalk Improvements Landscaping Street Lighting Erosion Control and Seeding Setting Iron Monuments Design, Administration, Inspection, As-Builts ORIGINAL CURRENT NEW AMOUNT AMOUNT AMOUNT $143,842 $72,000 $35,961 43,581 -0- -0- 89,930 -0- -0- 68,781 -0- -0- 2,000 -0- -0- 22,989 11,500 5,747 237,379 33,675 33,675 15,000 -0- -0- 26,014 13,007 10,406 4,900 -0- -0- 78,530 21,690 19,633 TOTAL $732,946 $151,872 $105,422 That the required financial guarantee and Letter of Credit No. 5504695 for the above items be reduced from $151,872 to $105,422. FURTHER BE IT RESOLVED that the financial guarantee requirements for the following items per Section 8.1 of the approved Development Contract remain as follows: ITEM ORIGINAL NEW AMOUNT AMOUNT Maintenance of Erosion and Sediment Control Plan, Street Sweeping, and Storm Sewer Cleaning Cash: $1,000 $1,000 FURTHER BE IT RESOLVED that the streets are accepted for continuous maintenance as of December 9, 2014, subject to the one-year guarantee by the Developer per Letter of Credit No. 5504695. APPROVED this 9th day of December, 2014.
