HomeMy WebLinkAboutCity Council Resolution 2014-373CITY OF PLYMOUTH RESOLUTION No. 2014-373 A RESOLUTION APPROVING A FINAL PLAT FOR "BASS LAKE PLAZA 5T" ADDITION" (2014112) WHEREAS, Astleford Properties has requested approval of a final plat for the roughly 12.4 -acre site located at the southwest corner of the intersection of Bass Lake Road (County Road 10) and Nathan Lane and legally described as Outlot A, Hickory Hills Villas, Hennepin County, Minnesota according to the recorded plat thereof. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Astleford Properties for a final plat for "Bass Lake Plaza 5t" Addition". FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A final plat is approved to allow the property to be subdivided into one lot for commercial development and one outlot for future residential development, in accordance with the application and plans received by the city on November 14, 17 and 18, 2014, except as may be amended by this resolution. 2. No driveway access from Lot 1, Block 1 shall be permitted to Bass Lake Road (County Road 10). 3. Future development on Lot 1, Block 1 shall be subject to all required reviews and approvals. No variances are granted or implied. 4. Prior to recording the final plat, the applicant shall: 1) submit an executed ten -foot trail easement adjacent to the Nathan Lane right-of-way from Bass Lake Road to the south property line of Outlot A; 2) remove the temporary off-site sign at the corner of Bass Lake Road and Nathan Lane; and 2) change "Nathen Lane North" to "Nathan Lane North" on the final plat. 5. Prior to issuance of a building permit for Lot 1, Block 1 or in conjunction with further subdivision of Outlot A, the property shall be subject to the following: wetland buffers, tree preservation, and applicable fees, including, but not limited to, sewer and water area assessments and park dedication, in compliance with City Code or zoning ordinance requirements at that time. 6. When development of Lot 1, Block 1 occurs, the applicant shall be responsible for constructing a trail from Bass Lake Road to the south property line of Lot 1. If Outlot A develops first, the trail shall be constructed from Bass Lake Road to the private drive near the south plat boundary. 7. Standard Conditions: a. No building permits shall be issued until the final plat and easements are filed and recorded with Hennepin County and proof of recording is submitted to the City. b. Compliance with the City's tree preservation regulations. Res. 2014-373 File 2014112 Page 2 c. No trees shall be planted in the public right-of-way. d. Signs shall require a separate permit and comply with section 21155 of the zoning ordinance. e. Removal of all hazardous trees from the property at the owner's expense. f. This approval shall expire two years after the date of approval, unless the applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 512 of City Code.
