HomeMy WebLinkAboutCity Council Resolution 2014-316CITY OF PLYMOUTH RESOLUTION No. 2014-316 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR LAKEWEST DEVELOPMENT COMPANY, LLC FOR "FRETHAM 23RD ADDITION" FOR PROPERTY LOCATED AT 18025 COUNTY ROAD 6 (2014035) WHEREAS, Lakewest Development Company, LLC has requested approval of a preliminary plat for roughly 2.92 acres of land presently legally described as follows: All that part of Government Lot 4, Section 30, Township 118, Range 22, lying South of County Road No. 6, EXCEPT that part of Government Lot 4, Section 30, Township 118, Range 22, described as follows: Commencing at the Southeast corner of said Government Lot 4; thence North along the East line thereof a distance of 573.5 feet; thence Westerly deflecting to the left 83 degrees 27 minutes, a distance of 480.25 feet; thence Southwesterly deflecting to the left 77 degrees, a distance of 76.35 feet; thence Northwesterly deflecting to the right 95 degrees 52 minutes, a distance of 151.01 feet; thence Northerly deflecting to the right 66 degrees 07 minutes 380.74 feet more or less to the Southerly line of County Road No. 6, as the same is now laid out and constructed; thence Southwesterly along the Southerly line of said County Road No. 6 to its intersection with the West line of said Government Lot 4; thence South along the West line of said Government Lot 4 to the Southwest corner thereof, thence East along the South line of said Government Lot 4 to the point of beginning. ALSO EXCEPT: That part of Government Lot 4, Section 30, Township 118, Range 22, described as follows: Commencing at a point on the East line of said Government Lot 4, distant 989.7 feet North of the Southeast corner thereof, thence Westerly, deflecting to the left 98 degrees 35 minutes a distance of 503.1 feet; thence deflecting to the right 71 degrees and 21 minutes a distance of 113.2 feet, more or less, to the South line of County Road No. 6; thence Easterly along the South line of said County Road No. 6 to its intersection with the East line of said Government Lot 4; thence South along the East line thereof to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lakewest Development Company, LLC for a preliminary plat for Fretham 23rd Addition, subject to the following conditions: A preliminary plat is approved for 5 single-family lots in accordance with the plans received by the city on May 8 and July 14, 2014, except as may be amended by this resolution. Res. 2014-316 File 2014035 Page 2 2. Prior to commencement of trading operations, the developer shall install and request inspection of tree preservation fencing and silt fencing. 3. Prior to recording the final plat, the applicant shall: 1) receive city approval of final construction plans; 2) execute a development contract and submit related fees and financial guarantees; and 3) remove the house and all accessory buildings and fences. 4. Prior to recording the final plat, the developer shall: a) Submit an executed trail and utility easement of 15 feet abutting the County Road 6 right- of-way. b) Revise the street name to Queensland Lane. c) Indicate the south property line of Lot 1 as a rear -yard. d) Relocate or remove the arborvitae and fence from the public right-of-way. e) Add a hydrant to the west side of Queensland Lane near County Road 6 in an approved location. f) Indicate a conforming driveway access for 18015 County Road 6 to Queensland Lane. g) Shift Queensland Lane five feet to the west within the same right-of-way. h) Submit an executed, five-foot sidewalk easement over Lot 1 adjacent to the right-of-way. i) Include "no parking" signs on one side of the local street. j) Provide restrictive covenants or homeowner association documents for the development that include language addressing the following: 1) prohibition of structures and clearing vegetation in wetland buffers; 2) maintenance for common elements including buffer monuments, boulevard stormwater treatment, mailboxes, monument signs, sidewalks, etc.; and 3) disclosures regarding the required maintenance of permeable driveways and boulevard plantings. k) The upland portion on the east side of Lot 3 (above the wetland) shall be platted as an outlot and offered to the owner of the adjacent property. 5. Parking is restricted to one side of the new local street. 6. When Queensland Lane is constructed, the applicant shall reorient the driveway for 18015 County Road 6 to Queensland Lane. The old driveway shall be removed and the ground restored to yard. 7. Standard Conditions: a. Except as otherwise allowed for one model home, no building permits shall be issued until the final plat, easements and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Development standards and setbacks for this plat shall comply with the RSF-1 zoning standards. No variances are granted or implied. c. Any signage shall require separate permits and shall comply with the city's sign regulations. d. Compliance with the city's tree preservation regulations. e. Removal of all hazardous trees at the owner's expense. Res. 2014-316 File 2014035 Page 3 f. No trees shall be planted in the right-of-way. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
