HomeMy WebLinkAboutCity Council Resolution 2014-303CITY OF PLYMOUTH RESOLUTION No. 2014-303 A RESOLUTION APPROVING AN AMENDMENT TO THE "ASPEN HOLLOW" DEVELOPMENT CONTRACT (2014008F) WHEREAS, the City of Plymouth approved a final plat and development contract for the first phase of Aspen Hollow on the property located west of Dunkirk Lane; and WHEREAS, the property is presently legally described as follows: The North Half of the Southwest Quarter of Section 5, Township 118 North of Range 22 West of the 5th Principal Meridian, Except North Half of the North Half of the Northeast Quarter of the Southwest Quarter of Section 5, Township 118, Range 22, Hennepin County, Minnesota. And the Registered Property is described as: The Southeast Quarter of the Southwest Quarter, Section 5, Township 118, Range 22, except the East 722.00 feet thereof, and The North 60.00 feet of the South 694.20 feet of the East 722.00 feet of the Southeast Quarter of the Southwest Quarter of Section 5, Township 118, Range 22, and, That part of the East 722.00 feet of the Southeast Quarter of the Southwest 1/4 of Section 5, Township 118, Range 22, lying North of the South 1011.30 feet thereof. WHEREAS, the city approved a development contract covering the improvements related to said plat; and WHEREAS, the applicant requested a revision to paragraph 19 of said development contract. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pulte Homes of Minnesota to amend the development contract for Aspen Hollow and the mayor and city manager be authorized to execute the amendment on behalf of the city. FURTHER, that city staff record the amendment to the development contract with Hennepin County. APPROVED this 23rd day of September, 2014.
