Resolution 2014-297 File 2014061 Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by Real Assets II, LLC for a PUD general plan, subject to the following conditions: 1. A PUD general plan is approved to allow 59 single-family dwellings, according to the plans received by the city on June 25 and August 12 and 13, 2014, except as amended by this resolution. 2. Approval of this PUD general plan is contingent on approval of a wetland mitigation plan. 3. Development standards shall be as indicated on the plans and materials dated June 25 and August 12, 2014, except as amended by this resolution. 4. The following setbacks shall apply to all lots, except as noted: a. A 25 -foot building setback measured from the rights-of-way of all adjacent streets. b. A 25 -foot rear building setback to the base lot property line. c. A 40 -foot rear setback between buildings within this development. d. A 14 -foot side setback between buildings and a 12 -foot setback between a deck and the dwelling on an adjacent property. e. A 50 -foot structure setback from the creek and 15 -foot setback to wetland buffers for buildings and 9 -foot setback to wetland buffers for decks and at -grade patios. f. In no instance shall any home, deck, air conditioner, egress window, etc. extend across a unit property line or within a drainage and utility easement. g. The following shall not be considered encroachments into the required setbacks as long as they do not project more than 30 inches into the required setback: cantilevers up to ten feet in width, chimneys up to six feet in width, flues, leaders, sills, pilasters, lintels, ornamental features, cornices, eaves, gutters, and the like. 5. For the portion of the development within the Bass Creek Shoreland Management District, impervious surface coverage shall be limited to a maximum of 25 percent of the total area, excluding public rights-of-way. The amount of impervious surface coverage allocated to each structure is limited to that shown on the final impervious surface area plan submitted as part of the final plat. 6. Prior to issuance of permits, the applicant must install the required permanent wetland buffer and conservation monuments pursuant to ordinance requirements and the final grading plan. 7. When the driveway to the property to the west is constructed, it shall be set back 15 feet from the adjacent dwellings. 8. The shoreland impact zone shall be maintained in a natural state and protected by conservation easements. Resolution 2014-297 File 2014061 Page 3 9. No recreational vehicles or equipment shall be stored outside garages or on the commonly -owned properties. 10. No home shall have driveway access to Bass Lake Road or Nathan Lane. 11. A minimum of 70 percent of the shoreland impact zone shall be undisturbed during construction and after construction, only native plantings shall be permitted. 12. All signage shall require separate permits and shall be in conformance with section 21155 in the zoning ordinance. APPROVED this 9th day of September, 2014.
