RESOLUTION No. 2014-293
A RESOLUTION APPROVING A PRELIMINARY PLAT FOR "TERRA VISTA 4TH" FOR
PROPERTY LOCATED AT 16405 COUNTY ROAD 47(2014058)
WHEREAS, GWS Land Development of Plymouth, LLC. has requested approval of a
preliminary plat for the roughly 5.8 -acre parcel presently legally described as:
Commencing at the northwest corner of the south 1530 feet of the east 759 feet of the northeast
quarter of section 5, township 118, range 22, thence on an assumed bearing of south 0 degrees, 0
minutes, 12 seconds west along the west line of said east 759 feet of the northeast 1/4a distance of
22 feet; thence south 70 degrees, 24 minutes, 32 seconds west a distance of 170.33 feet to the
point of beginning of the land to be described; thence south 0 degrees, 09 minutes, 50 seconds
west a distance of 318.76 feet; thence south 70 degrees, 24 minutes, 32 seconds west a distance
of 757.87 feet to the west line of the east 5/8 of said northeast 1/4; thence north 0 degrees, 09
minutes, 50 seconds east a distance of 1093.49 feet to the center line of County Road no 47,
thence easterly along said center line to its intersection with a line 30 feet east of, measured at
right angles to, and parallel with the west line of said east 5/8 of northeast i/4; thence south 0
degrees, 09 minutes, 50 seconds west along said parallel line a distance of 774.73 feet to its
intersection with a line bearing south 70 degrees, 24 minutes, 32 seconds west from the point of
beginning; thence north 70 degrees, 24 minutes, 32 seconds east a distance of 726 feet to the
point of beginning, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request for a preliminary plat at a duly
called public hearing and recommends approval, and,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by GWS Land Development of Plymouth, LLC. for a preliminary plat for
"Terra Vista 4th", subject to the following conditions:
1. A preliminary plat is approved to allow the property to be subdivided into six lots for single-
family homes, in accordance with the application and plans received by the city on June 17,
2014, except as may be amended by this resolution.
2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning
and variances to lot arrangement and wetland buffers.
3. Prior to recording the final plat, the applicant shall: 1) receive city approval of final
construction plans; 2) execute a development contract and submit related fees and financial
guarantees; and 3) remove the house and all accessory buildings and fences.

4. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the
required information, and revise the plans as indicated below, consistent with the applicable
city code, zoning ordinance, and engineering guidelines:
a. Combine Outlot A with Lot 2 or consolidate with other adjacent properties and combine
Outlot B with Lot 5 and/or 6 or other acceptable alternative as shown in the final plat
application.
b. Revise the plat to dedicate right-of-way for 601h Avenue North to be extended across
Outlot A.
c. Submit an executed encroachment agreement for retaining walls in drainage and utility
easements.
d. Amend the plan to include right-of-way dedication for County Road 47 consistent with
the Terra Vista plat.
e. Submit an executed 10 -foot snow storage easement (for the future trail) along County
Road 47 consistent with the Terra Vista plat.
f. Submit HOA documents or restrictive covenants that: 1) assign maintenance of the
wetland buffers, buffer monuments, shared driveway, sidewalks and retaining walls; 2)
disclose the location of utility access easements and shared driveway serving Lots 5 and
6; and 3) establishes a reserve for future shared driveway improvements.
g. Revise the plat to indicate a drainage and utility easement over Outlot A.
h. Add and relocate wetland buffers to approved locations.
i. Increase the buffer width to 50 -feet along the east side of Lot 6.
j. Provide a looped water main system for the development.
k. Relocate hydrants to approved locations.
1. Indicate the location for an address sign for Lots 5 and 6 on Zanzibar Lane. The sign
must be installed prior to issuance of a certificate of occupancy for the lots.
m. Submit fire -flow calculations flowing 1) the private drive hydrant and the Zanzibar Lane
hydrant simultaneously and 2) solely the private drive hydrant.
n. Indicate the high water elevation for all ponds and wetlands and indicate the lowest floor
elevation two feet above the high water elevation for all adjacent homes.
5. Prior to the issuance of a building permit, the applicant shall submit a survey indicating:
a. A minimum of two front yard trees to be preserved or planted, and
b. Silt fence and tree preservation fencing installed consistent with city code.
6. Standard Conditions:
a. With the exception of a model home, no building permits shall be issued until the final
plat, easements and agreements are filed and recorded with Hennepin County.
b. All retaining walls over four feet shall require issuance of a building permit and a three-
foot fence installed on top of the wall.
c. Compliance with the city's tree preservation regulations.
d. No trees shall be planted in the public right-of-way.
e. Signs shall require a separate permit and comply with section 21155 of the zoning
ordinance.
f Removal of all hazardous trees from the property at the owner's expense.

g. This approval shall expire one year after the date of approval, unless the applicant has
filed a complete application for final plat, or unless the applicant, with the consent of the
property owner, has received prior approval from the city to extend the expiration date
for up to one additional year, as regulated under section 510 of city code.
