HomeMy WebLinkAboutCity Council Resolution 2014-292CITY OF PLYMOUTH RESOLUTION NO. 2014-292 A RESOLUTION APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED AT 16405 COUNTY ROAD 47 (2014058) WHEREAS, GWS Land Development of Plymouth, LLC., has requested reclassification of the zoning from FRD (future restricted development) to RSF-3 (single family 3) for the roughly 5.8 -acre site presently legally described as: Commencing at the northwest corner of the south 1530 feet of the east 759 feet of the northeast quarter of section 5, township 118, range 22, thence on an assumed bearing of south 0 degrees, 0 minutes, 12 seconds west along the west line of said east 759 feet of the northeast % a distance of 22 feet; thence south 70 degrees, 24 minutes, 32 seconds west a distance of 170.33 feet to the point of beginning of the land to be described; thence south 0 degrees, 09 minutes, 50 seconds west a distance of 318.76 feet; thence south 70 degrees, 24 minutes, 32 seconds west a distance of 757.87 feet to the west line of the east 5/8 of said northeast 1/4; thence north 0 degrees, 09 minutes, 50 seconds east a distance of 1093.49 feet to the center line of County Road no 47, thence easterly along said center line to its intersection with a line 30 feet east of, measured at right angles to, and parallel with the west line of said east 5/8 of northeast %; thence south 0 degrees, 09 minutes, 50 seconds west along said parallel line a distance of 774.73 feet to its intersection with a line bearing south 70 degrees, 24 minutes, 32 seconds west from the point of beginning; thence north 70 degrees, 24 minutes, 32 seconds east a distance of 726 feet to the point of beginning, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcels from FRD to RSF-3. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD to RSF-3 for the roughly 5.8 -acre site located at 16405 County Road 47, based on the following findings: 1. The RSF-3 zoning would be consistent with the intent of the LA -R2 guiding. 2. The proposed density is consistent with the intent of the LA -R2. 3. The proposed single-family development would be consistent with the comprehensive plan and would comply with city standards. 4. Adequate infrastructure would be available to support the proposed development for this site. APPROVED this 9th day of September, 2014.
