HOVNANIAN HOMES OF MINNESOTA, LLC FOR "RIDGECREST AT ELM CREEK" FOR PROPERTY LOCATED NORTH OF COUNTY ROAD 47 AND EAST OF LAWNDALE LANE (2014028) WHEREAS, K. Hovnanian Homes of Minnesota, LLC has requested approval of a preliminary plat for roughly 28.8 acres of land presently addressed as 6020, 6040, 6110, & 6140 Lawndale Lane, and presently legally described as follows: That part of the North Half of the Northwest Quarter of Section 5, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Beginning at the Northwest corner of said Section 5; thence South, along said West line of said Section 5, a distance of 355.4 feet; thence East, parallel with the South line of said North Half of Northwest Quarter, a distance of 1,154.77 feet; thence Northeasterly to a point on the North line of said Section 5, a distance of 1,299 feet East of said Northwest corner of Section 5, thence West along the said North line, a distance of 1,299 feet to said point of beginning. AND That part of the North Half of the Northwest Quarter of Section 5, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Beginning at a point on the West line of said Section 5, a distance of 355.4 feet South of the Northwest corner of said Section 5; thence South along said West line a distance of 300 feet; thence East and parallel with the South line of said North Half of the Northwest Quarter, a distance of 1,031.5 feet; thence Northeasterly along a line which if extended Northeasterly would intersect the North line of said Section 5 a distance of 1,299 feet East of said Northwest corner of Section 5, a distance of 336.10 feet; thence West parallel with said South line a distance of 1,154.77 feet to said point of beginning. AND The Northerly 261.5 feet of the West Half of that part of the North Half of the Northwest Quarter of Section 5, Township 118, North Range 22, West of the 5th Principal Meridian described as follows: Res. 2014-291 File 2014028 Page 2 Commencing at a point where the West line of said Section 5 intersects the centerline of County Road No. 47; thence East along said centerline 1,333 feet; thence North parallel with the West line of Section 5, 704 feet; thence West parallel with the centerline of County Road No. 47, 1,333 feet to the West line of said Section 5; thence South along said West line Section 5 to the point of beginning, Hennepin County, Minnesota. AND The South 442.5 feet of the following tract: The West Half of that part of the North Half of the Northwest Quarter of Section 5, Township 118, North Range 22, West of the 5th Principal Meridian described as follows: Commencing at a point where the West line of said Section 5, Township 118, Range 22, intersects the centerline of County Road No. 47; thence East along the centerline of said County Road 47, 1,333 feet; thence North parallel to the West line of Section 5, 704 feet; thence West on a line parallel to the centerline of County Road No. 47, 1,333 feet more or less, to the West line of said Section 5; thence South on the West line Section 5, 704 feet, more or less to the point of beginning, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by K. Hovnanian Homes of Minnesota, LLC for a preliminary plat for Ridgecrest at Elm Creek, subject to the following conditions: 1. A preliminary plat is approved for 56 single-family lots, in accordance with the plans received by the city on August 13, 2014 and revised plans received on September 4, 2014, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site. 3. Prior to issuance of a 2radin2 hermit and commencement of 2radin2 operations: a. grading shall be underway on Lawndale Lane construction adjacent to the subject property; and b. the developer shall install and request inspection of tree preservation fencing and silt fencing. 4. No utility installation shall commence until utility installation has commenced on Lawndale Lane adjacent to the subject property. Res. 2014-291 File 2014028 Page 3 5. No curb and gutter or paving shall be allowed until paving has started on Lawndale Lane adjacent to the subject property. 6. Prior to recording the final plat, the developer shall: a. Remove the existing structures from the site. Demolition permits are required for removal of existing structures. b. Provide a separate ten -foot wide trail easement along the west side of those properties that abut Lawndale Lane, and along the south side of those properties that abut County Road 47. c. Execute the development contract and provide the related financial guarantees and fees. d. Receive city approval of final construction plans. e. Demonstrate that adequate access is provided to the pond. f Pay the required park dedication cash fee. 7. Prior to issuance of building permits for lots abutting wetlands, permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. 8. The developer shall notify potential property owners and homebuyers about the future roadway extension of 60th Avenue within the plat. 9. In conjunction with submission of the final plat application, the developer shall submit homeowner's association documents for city review. The homeowner's association documents shall address: a) responsibilities for maintenance and repair of developer - installed retaining walls, wetland buffers, buffer monuments, sidewalks, landscaped median island at the site entrance, and any other similar or common features, and b) prohibition on structures and the clearing of native vegetation from the wetland buffers. 10. The 60th Avenue stub street, utilities, and sidewalk shall be constructed to the east plat boundary. A temporary cul-de-sac turn -around will not be required at the end of that street if the street is barricaded near Jewel Lane. 11. Construction access to Lawndale Lane may be limited or restricted during the Peony Lane/Lawndale Lane road construction project. 12. Lots located entirely within the shoreland overlay district for Elm Creek shall comply with the maximum impervious surface coverage regulations specified in section 21665 of the zoning ordinance. 13. Secondary access for the development is hereby waived. 14. Standard Conditions: a. An approved looped watermain system is required that is connected to two separate watermains. Res. 2014-291 File 2014028 Page 4 b. Relocate hydrant to locations as approved by the Fire Inspector. c. Submit fire flow calculations with the final plat application. d. Except as otherwise may be allowed for a model home, no building permits shall be issued until: 1) the final plat is filed and recorded with Hennepin County; and 2) reconstructed Lawndale Lane is open for traffic between County Road 47 and the Plymouth/Maple Grove border. e. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. f. Any signage shall require separate permits and shall comply with the city's sign regulations. g. The sidewalks along all streets shall be installed at the same time the streets are installed. h. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. i. Compliance with the city's tree preservation regulations. j. Removal of all hazardous trees at the owner's expense. k. Except for the landscaped median island at the site entrance, no trees shall be planted in the boulevard. 1. This approval shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
