CITY OF PLYMOUTH
HENNEPIN COUNTY, MINNESOTA
AN ORDINANCE AMENDING CHAPTERS IV, IX, AND X OF THE
PLYMOUTH CITY CODE RELATIVE TO BUILDING
CONSTRUCTION REGULATIONS, FIRE PROTECTION CODE,
AND PERMIT PROCEDURES AND FEES
THE CITY COUNCIL OF PLYMOUTH, MINNESOTA ORDAINS:
SECTION 1. Section 400 of the Plymouth City Code is hereby amended as
follows:
400.01 Building Code. The Minnesota State Building Code, established pursuant
to Minnesota Statutes 16B.59 to ' 6B.75326B. is hereby adopted as the building code for
the City of Plymouth. The code is hereby incorporated as completely as if fully set out
herein.
A. The Minnesota State Building Code includes the following chapters of
Minnesota Rules:
1. 1300, Administration of the Minnesota State Building Code;
2. 1301, Building Official Certification;
3. 1302, State Building Code Construction Approvals;
4. 1303, Minnesota Provisions;
5. 1305, Adoption of the 2006 International Building Code;
6. 1306, Speeial Fire Pr-oteetion Systems;
7:6. 1307, Elevators and Related Devices;
8:7. 1309, Adoption of the 2006 International Residential Code;
9-.8. 1311, Adoption of the 2006-2000 Guidelines for the Rehabilitation
of Existing Buildings;
44:9. 1315, Adoption of the 2005-2008 National Electrical Code;

400.03 Application, Administration and Enforcement. The application,
administration, and enforcement of the code shall be in accordance with Minnesota A"'a
Chapter- 1300 the Minnesota State Building Code. The code shall be enforced within the
extraterritorial limits permitted by Minnesota Statues, 'moi 326B.121, subdivision
Imo, when so established by this ordinance. The Building Inspection Division is the
code enforcement agency for the City of Plymouth, including electrical inspections and
permits. This code shall be enforced by the Minnesota Certified Building Official
designated by the City of Plymouth to administer the code in accordance with Minnesota

400.05 Violations and Penalties. A violation of the code is a misdemeanor
(Minnesota stake -Statute 32613.082 subdivision 161619) and Minnesota Rules,
Chapter 1300.
400.07 Permit and Fees. The issuance of permits and the collection of fees shall
be as authorized in MinnesotaStatues, ••'�
6B.62, sdivi �ei�Rules Chapter 1300.
Permit fees shall be assessed for work governed by this code in accordance with the fee
schedule adopted in Section 1015 of the Plymouth City Code. In addition, a surcharge
fee shall be collected on all permits issued for work governed by this code in accordance
with Minnesota statute Statutes 326B.148.
400.09 The Minnesota State Building Code includes the following chapters of
Minnesota Rules:
(1) Chapter 1306, Special Fire Protection Systems.
(2) Chapter 1335, Flood Proofing Regulations, Parts 1335.0600 to 1200.
(3) Appendix Chapter J (Grading), of the 2006 International Building Code.
The following optional provisions identified in Section 400.09 (1) are hereby adopted and
incorporated as part of the building code for the City of Plymouth.

SECTION 2. Section 905 of the Plymouth City Code is hereby amended as
follows:
905.01. State Fire Code. Subdivision 1. Minnesota State Fire Code Adopted.
The Minnesota State Fire Code (2006 Edition of the International Fire Code) is hereby
adopted as the fire code for the City, for the purpose of prescribing regulations
governing conditions hazardous to life and property from fire or explosion. Every
provision contained in the Minnesota State Fire Code, except as modified or amended
by this Section, is hereby adopted and made a part of this Section as if fully set forth

Subd. 2. Enforcement. The Building Official serving the City, or the
representative authorized by the Building Official, shall enforce the provisions of this
Section.
Subd. 3. Minnesota. State Fire Code Definitions Applied to this Section.
(a) Wherever the word "jurisdiction" is used in the Minnesota State Fire
Code, it shall be held to mean the City of Plymouth.
(b) Wherever the word "municipality is used in the Minnesota State Fire
Code, it shall be held to mean the City of Plymouth. (Ord. 2003-22,

(c) Wherever the words "Fire Chief or Code Official" are used in the
Minnesota State Fire Code, it shall be held to mean the Building Official
for the City of Plymouth or the Building Official's authorized designee.

Subd. 4. Amendments Made in the Minnesota State Fire Code. The following
sections of the Minnesota State Fire Code are amended as follows:
(a) Section 503.2.3 Surface. Fire apparatus access roads shall be designed
and maintained to support the imposed loads of fire apparatus and shall
be paved having a seven ton driving capacity.
(b) Section 508.5.1 Exceptions:
1. For buildings other than those regulated by the International Residential Code
equipped throughout with an approved automatic sprinkler system installed in
accordance with NFPA 13 or NFPA 13R, the distance requirement shall be one fire
hydrant within 50 feet of the fire department connection, and 600 feet for other fire
hydrants.
(c) In addition to the appendices to the International Fire Code adopted in
the Minnesota State Fire Code, the following appendix of the
International Fire Code is adopted as part of the fire code for the City:

SECTION 3. Section 1015.13 of the Plymouth City Code is hereby amended as
follows:

SECTION 4. Section 1015.19 of the Plymouth City Code is hereby amended as follows:

SECTION 5. Sections 1 and 2 of this ordinance shall become effective immediately
upon passage and publication and Sections 3 and 4 of this ordinance shall become
effective on April 1, 2009.
