HomeMy WebLinkAboutCity Council Resolution 2014-275CITY OF PLYMOUTH RESOLUTION No. 2014-275 RESOLUTION APPROVING AMENDMENTS TO CONDITIONAL USE PERMITS, VARIANCES AND FINAL PLAT FOR PROPERTY LOCATED AT 18205 45TH AVENUE NORTH (2004051 ) WHEREAS, Scherer Limited Partnership requested approval to amend the conditional use permits and variances for the site legally described as CIC No. 1957 Plymouth Office Plaza II, Units 18205A -D; WHEREAS, the City Council approved resolutions 2004-308 and 2004-463 with conditions that prohibit medical, dental and chiropractic uses in any unit on the site; and, WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Scherer Limited Partnership for amendment to the conditional use permits and variances for the property located at 18205 45th Avenue North, subject to the following conditions: 1. The conditional use permits and variances approved by Resolution 2004-308 and the final plat approved by Resolution 2004-463 are hereby amended to allow medical, dental and chiropractic uses in the building addressed as 18205 45th Avenue North, in accordance with the application and plans received by the city on July 1 and 14, 2014, except as may be amended by this resolution. 2. The conditional use permits and variances are amended with the finding that all applicable conditional use permit and variance standards are met. 3. Medical, dental and chiropractic uses shall be permitted in only one building — 18205 45th Avenue North. All other conditions in Resolutions 2014-308 and 204-463 shall remain in effect. 4. Should parking demand for the site increase beyond the parking provided, the applicant and property owners shall be responsible for increasing the supply of parking. 5. All parking spaces and the trash/recycling enclosure shall be required to be outside the high water level of the drainage pond. 6. Prior to occupancy of the building, the applicant must obtain separate approval of a building permit. Res. 2014-275 File 2004051 Page 2 7. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 8. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21015.07 and 21030.06 of the zoning ordinance.
