HomeMy WebLinkAboutCity Council Resolution 2014-271CITY OF PLYMOUTH RESOLUTION 2014-271 RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW RETAIL SALES OF ASPHALT EMULSION AT 2601 NIAGARA LANE (2014056) WHEREAS, Plymouth Industries has requested approval of a conditional use permit to allow retail sales of asphalt emulsion at 2601 Niagara Lane, legally described as follows: That part of the East 570 feet of Lot 1, Block 2, Metro Industrial Park, lying South of a line described as follows: Beginning at a point on the East line of the Southwest Quarter of Section 21, Township 118, Range 22 a distance of 532.58 feet North from the Southest corner thereof, thence Westerly at a right angle with said East line to the West line of said East 570 feet, and there ending. Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Plymouth Industries for a conditional use permit at 2601 Niagara Lane, subject to the following conditions: 1. A conditional use permit is approved to allow retail sales of asphalt emulsion and related installation of a 6,000 gallon storage/dispensing tank, in accordance with the application and plans received by the City on June 20, 2014, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that the proposal complies with the applicable conditional use permit standards. 3. Prior to installation of the tank, the applicant shall obtain separate approval of all required permits such as a tank permit and electrical permit. 4. Prior to approval of the tank permit, the applicant shall address the following items with the City Fire Inspector: a. Provide a specification sheet from the tank manufacturer that identifies the tank construction and listing for product stored. b. Provide spill containment details and materials. c. Provide the required information placard on the tank. d. Provide bollards around the tank in approved locations. e. Identify hydrant locations on the site plan. f. Provide fire lane signage in locations as approved by the Fire Inspector. Resolution 2014-271 (2014056) Page 2 5. Replacement of the existing wood screen fencing with a ten -foot high chain link fence with privacy slats requires prior approval of a building permit. 6. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals pursuant to ordinance provisions. b. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
