RESOLUTION No. 2014-266
RESOLUTION APPROVING ENCROACHMENT AGREEMENT
FOR A DECK WITHIN A DRAINAGE EASEMENT ON
LOT 2, BLOCK 1, PHEASANT TRAILS
WHEREAS, property owners, requested the City to approve an encroachment agreement for a deck
within a drainage easement on Lot 10, Block 3, Heritage Woods Estates 2nd Addition; and
WHEREAS, the encroachment agreement permits only the deck currently within the easement and all
related facilities must still meet all applicable City codes; and
WHEREAS, the existing deck that was constructed prior to 1998 is due for replacement and the
proposed deck will be constructed to a similar size of the existing deck; and
WHEREAS, the owners property is legally described as Lot 2, Block 1, Pheasant Trails.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of
Plymouth, the encroachment agreement for the deck located in the drainage easement.
