HomeMy WebLinkAboutCity Council Resolution 2012-251CITY OF PLYMOUTH RESOLUTION No. 2012-251 A RESOLUTION REQUESTING THE PUBLIC UTILITIES COMMISSION TO REFER THE CERTIFICATE OF NEED PROCEEDING FOR THE HOLLYDALE TRANSMISSION LINE PROJECT, DOCKET NO. CN -12-113, FOR A CONTESTED CASE HEARING WI-1EREAS, the Public Utilities Commission has previously referred the route -permit application for the Hollydale Transmission Line Project, Docket No. TL11-152, for a fiill permitting process, environmental impact statement, and contested -case hearing; and WIffiREAS, the Applicants in the Hollydale Transmission Line Project have filed a Certificate of Need Application in which there is a material fact dispute as to whether distribution -level alternatives can resolve the forecasted distribution -level deficit in Plymouth and Medina with fewer impacts and less controversy than the proposed Hollydale 115kV high- voltage -transmission line; and VJ-IEREAS, Minnesota's Administrative Rules provide that the Public Utilities Commission shall refer a matter to the Office of Administrative Hearings for a contested -case proceeding if the matter involves contested material facts; and WIffiREAS, a contested -case Certificate of Need proceeding would allow for a fiill fact- finding hearing as to the feasibility of alternatives to a 115kV transmission line; BE IT RESOLVED that the Plymouth City Council urges the Public Utilities Commission to refer the Certificate of Need proceeding for the Hollydale Transmission Line Project, Docket No. CN -12-113, for a contested -case hearing to allow for a fiill fact-finding hearing to determine if there are other low -voltage alternatives that can provide reliable energy to the Plymouth community. BE IT FURTHER RESOLVED that in the event that the result of a contested -case hearing leads to a finding that there is no feasible alternative other than a 115kV transmission line, the Plymouth City Council urges the Public Utilities Commission to choose routes that have the least impact on homes and residents in the Plymouth community. Approved this 14th day of August 2012.
