HomeMy WebLinkAboutCity Council Resolution 2012-248CITY OF PLYMOUTH RESOLUTION No. 2012-248 A RESOLUTION APPROVING A SITE PLAN, CONDITIONAL USE PERMITS, AND VARIANCES FOR A 911 EMERGENCY COMMUNICATIONS FACILITY AT 1245 SHENANDOAH LANE (2012036) WHEREAS, Hennepin County has requested approval of a site plan, conditional use permits, and variances to allow constriction of a 911 emergency communications facility at 1245 Shenandoah Lane; and WHEREAS, the subject property is legally described as follows: Par 1: That part of Government Lot 4, Section 28, Township 118, Range 22 lying Southerly of the line designated "survey line" on the Plat of Hennepin County State Aid Highway No. 6, Plat 5 which lies Westerly of the center line of the 66 foot wide right of way of Shenandoah Lane, said center line is described as follows: Commencing at the Southwest corner of said Section 28; thence on an assumed bearing of South 88 degrees 55 minutes 08 seconds East, along the South line of said Section a distance of 1228.98 to the beginning of the center line to be described; thence North 12 degrees 37 minutes 44 seconds West a distance of 638.89 feet; thence Northerly a distance of 342.08 feet along a tangential curve concave to the East having a radius of 4878.93 feet and a central angle of 4 degrees 01 minute and 02 seconds; thence North 8 degrees 36 minutes 42 seconds West, tangent to said curve a distance of 176.34 feet to the intersection with the above-mentioned "survey line" and there terminating. Par 2: Those parts of the following described tracts of land: All that part of Government Lot 1 of Section 33, Township 118, Range 22 described as follows: Commencing at the Northwest corner thereof, thence South on the West line thereof to the Southwest corner thereof, thence East along the South line thereof 1272 feet more or less to the Northeast corner of the Southwest Quarter of the Northwest Quarter of Section 33; thence North at right angles 732 feet; thence East at right angles 520 feet more or less to Parker's Lake, thence Northwesterly along the shore of said lake to the North line of said lot, thence West along the North line thereof to point of beginning, and Beginning at the Northwest Corner of the Southeast Quarter of the Northwest Quarter of Section 33, Township 118 North Range 22 West; the East along the North line of said tract 532 feet; thence North 24 degrees and 5 minutes East 110.5 feet to the point of beginning of the land to be hereinafter described; thence North 24 degrees and 5 minutes East to the shore of Parker Lake; thence Northwesterly along the shore of said lake to a point due East of a point 732 feet North of said Northwest corner of said Southeast Quarter of the Northwest Quarter of said Section 33 which said point on the West shore of said Parker Lake is described in the deed recorded in the office of the Register of Deeds in and for said Hennepin County in Book 231 of Resolution 2012-248 (2012036) Page 2 Deeds, Page 55 as marked on a dead elm tree and a fence in said Section; thence Westerly and parallel to the North boundary line of the Northeast Quarter of the Southwest Quarter of said Section, 510 feet more or less to said point distant 732 feet North of said Northwest corner of said Southeast Quarter of the Northwest Quarter of said Section; thence South 647 feet to a point 85 feet North of said Northwest corner of said tract; thence Easterly to the place of beginning: which lie Westerly of the center line of the 66 foot wide right-of-way of Shenandoah Lane, said center line is described as follows: Commencing at the Northwest corner of said Section 33; thence on an assumed bearing of South 88 degrees 55 minutes 08 seconds East along the North line of said Section 33 a distance of 1228.98 feet to the beginning of the center line to be described; thence South 12 degrees 37 minutes 44 seconds East a distance of 30.87 feet; thence Southeasterly a distance of 377.54 feet along a tangential curve concave to the Northeast having a radius of 1145.92 feet and a central angle of 18 degrees 52 minutes 38 seconds; thence South 31 degrees 30 minutes 22 seconds East, tangent to said curve, a distance of 144.55 feet; thence Southeasterly a distance of 174.44 feet along a tangential curve concave to the Southwest having a radius of 954.93 feet and a central angle of 10 degree 28 minutes 00 seconds; thence South 21 degrees 02 minutes 22 seconds East, tangent to said curve, a distance of 149.01 feet; thence Southeasterly a distance of 180.00 feet along a tangential curve concave to the Southwest having a radius of 1432.40 feet and a central angle of 7 degrees 12 minutes 00 seconds; thence South 13 degrees 50 minutes 22 seconds East, tangent to said curve, a distance of 400 feet and said center line there terminating. Subject to a right of way for an electric railway over and across that part of Said Government Lot 1 described as follows: Commencing at the Southwest corner of said Lot, thence East on the South line thereof 1272 feet, thence North at right angles 80 feet, thence West in a straight line to a point on the West line thereof 58 feet North of the point of beginning, thence South on said line to point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hennepin County for a site plan, conditional use permits, and variances to allow constriction of a 59,550 -square foot 911 emergency communications facility on the site of the adult correctional facility located at 1245 Shenandoah Lane, subject to the following conditions and findings: 1. The proposal is hereby approved, in accordance with the application and plans received by the City on May 24, 2012, except as may be amended by this resolution. 2. The conditional use permit requested to allow an additional principal building on the site is hereby approved based on the finding that all applicable conditional use permit standards have been met. The conditional use permit requested to allow barbed wire along portions of the fencing north, west, and south of the 911 building is hereby approved based on the finding that all applicable conditional use permit standards have been met. 4. The variance requested to allow impervious surface coverage of up to 26.1 percent for the overall site (includes impervious coverage for a future addition to the men's detention center) is hereby approved based on the finding that all applicable variance standards have been met. 5. The variance requested to allow eight -foot high fencing in the front yard area between the building and Shenandoah Lane, and eight -foot high fencing plus barbed wire for other fencing is hereby approved based on the finding that all applicable variance standards have been met. 6. Prior to issuance of building permits, the following items shall be completed: a. The applicant shall submit a site improvement performance agreement for completion of site improvements, as required by the city. b. The applicant shall obtain the necessary permits and approvals as follows: Bassett Creels Watershed Management Organization and NPDES. c. The applicant shall provide a maintenance agreement for the bio -retention and sand filter areas. d. The applicant shall provide the city with a 20 -foot wide utility easement for the sanitary sewer line that would be relocated. 7. Prior to issuance of building permits, the applicant shall revise the plans, as follows: a. Grading and erosion control plan: 1) Add to General Note I and to Utility Notes: City of Plymouth Engineering Guidelines and Standard Detail Specifications shall apply. 2) Indentify inlet protection on the plan for the existing storm sewer stricture. b. Utility plan: 1) All "C" civil drawings shall be no larger then 24 inches by 36 inches. 2) Provide the final set of plans in "DWG" and "PDF" format prior to beginning constriction. 3) Add city detail STRT-8 to the detail sheets and note it on Plan C1.3 entitled Finishing Plan. 4) Indicate all new storm sewer recently installed by the city along Shenandoah Lane. 5) Provide a storm sewer casting and stricture schedule on the plan. 6) All new water mains shall be PVC C900. Resolution 2012-248 (2012036) Page 4 7) The abandoned sanitary sewer within right -of way shall be blown full with sand from the existing manhole. 8) Add to the Utility Notes that all storm sewer 8 inches and larger shall be televised at the owner's expense and the report submitted to the City Engineering Department for review prior to paving. 9) Add to the Utility Notes that all storm sewers shall be inspected by the City Engineering Department during installation, and to call 763-509-5500 before starting storm sewer work to schedule an inspection. 10) Indicate core drilling of the connections to the new sanitary sewer manholes installed at the two existing pipe connections. c. Water resources plan 1) Demonstrate a 60 percent reduction in total phosphorus loading for new impervious areas. d. Fire protection plan 1) Relocate hydrants to locations as approved by the Fire Inspector. 2) Locate the fire department connection in an approved location near the main entry door on the east side of the building. 3) Identify the post -indicator valve location. 4) Fire lane signage is required on drives and locations not designated as parking, in locations as approved by the Fire Inspector. 5) Submit turning radius evaluations for all Fire Department vehicles. 6) Submit fire flow calculations flowing the two most remote and highest elevation hydrants simultaneously. 7) The site hydrant water main system should connect to two separate water mains, if possible, to ensure site water if one connection is out of service. 8) Submit details on opening operations for the lift arm gates and the double -swinging gates. 9) A separate tank permit is required for the diesel fi el tanks related to the generators. 10) All drive aisles shall be constricted to a minimum of seven ton capacity and paved. 8. The 911 emergency communications facility shall not be used by deputies or other law enforcement personnel as a base location for response to calls for service. 9. Standard Conditions: a. Any signage shall comply with the signage regulations and shall receive prior approval of the appropriate sign permit. b. The applicant shall submit a reproducible 8'/2 inch x 11 inch "as built" fire protection plan prior to the release of any financial guarantees. c. Trash and recycling storage shall be in compliance with the zoning ordinance. Resolution 2012-248 (2012036) Page 5 d. The site plan, conditional use permits, and variances shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09, 21015.07, and 21030.06, respectively, of the zoning ordinance.
