HomeMy WebLinkAboutCity Council Resolution 2014-254CITY OF PLYMOUTH RESOLUTION No. 2014-254 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "ROSE GARDEN" FOR PROPERTY LOCATED SOUTH OF HIGHWAY 55 AND WEST OF COUNTY ROAD 101 2014007-F) WHEREAS, Landform Professional Services has requested approval of a final plat for 20 townhome unit lots and one common open space lot on roughly 9 acres located south of Highway 55 and west of County Road 101; and WHEREAS, the property is presently legally described as follows: That part of the West Half of the Northwest Quarter of the Northeast Quarter of Section 18, Township 118, Range 22, lying South of State Highway No. 55 as now traveled and used, Hennepin County, Minnesota. WHEREAS, City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Landform Professional Services for a final plat for Rose Garden; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Rose Garden is approved in accordance with the application and plans received by the City on June 16 and June 24, 2014, except as may be amended by this resolution. 2. Prior to recording the final plat, the developer shall: a) Execute the development contract and provide the related financial guarantees and fees. b) Pay the required park dedication fee. c) Provide a separate ten -foot wide trail easement along the northeast boundary of all lots that would abut Hamel Road. d) Provide an encroachment agreement where retaining walls are located in drainage and utility easements. e) Submit a recordable bio -retention basin maintenance agreement for City review. Upon City approval, the bio -retention basin maintenance agreement shall be recorded with the final plat. No building permits shall be issued until evidence of recording of the agreement is provided. Resolution 2014-254 File 2014007-F Page 2 f) Enter into an agreement to be assessed for one half of the cost of a future City project to construct the Hamel Road segment lying along the east boundary of the site. Such agreement shall be recorded with Hennepin County immediately upon recording of the plat. No building permits shall be issued until evidence of recording of the agreement is provided. g) Receive City approval of final construction plans. h) Obtain watershed approval. 3. Prior to issuance of building permits, the developer shall install permanent wetland buffer monument signs pursuant to ordinance requirements. 4. The homeowner's association documents shall address: a) responsibilities for maintenance of the wetland areas within the site, wetland buffers, buffer monuments, retention basin, private drive system, signage (including required address signs and "no parking -fire lane" signs), retaining walls, and any other similar or common features; b) prohibition on structures and the clearing of native vegetation from the wetland buffers; c) individual unit driveways extending onto neighboring unit lots; and d) maintenance of and access to private utilities (e.g., sewer and water services) that cross individual property lines onto association property. 5. The developer shall notify potential buyers about the future street improvement project for Hamel Road. 6. Standard Conditions: a) Development standards and setbacks for this plat shall comply with the RMF -2 zoning standards. No variances are granted or implied. b) The range of addresses must be posted on signage visible from Hamel Road near the private drive entrances. c) Fire lane signage shall be required along both sides of the private drive system, in locations as approved by the Fire Inspector. d) Relocate hydrant "b" to the intersection of Hamel Road and the west private drive, as specified and approved by the Fire Inspector. e) Any signage shall require separate permits and shall comply with the City's sign regulations. f) Compliance with the City's tree preservation regulations. g) Removal of all hazardous trees at the owner's expense. h) No trees shall be planted in the boulevard. i) Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. j) This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 512 of City code.
