HomeMy WebLinkAboutCity Council Resolution 2014-185CITY OF PLYMOUTH RESOLUTION No. 2014-185 A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT FOR "FERNDALE TERRACE" FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF FERNDALE ROAD AND COUNTY ROAD 6 (2014011) WHEREAS, Rachel Contracting. has requested approval of a preliminary and final plat for the 4.7 acres presently legally described as follows: That part of government lot 6, section 30, township 118, range 22, lying westerly of the west line of Hunter's Bluff and its northerly extension, which lies between the north line of the south 30 feet of said government lot 6 and a line drawn easterly at an angle of 87 degrees 15 minutes, measured south to east from a point on the west line of said government lot 6 distant 358.38 feet northerly from the southwest corner of said section 30. Subject to a highway easement in favor of the County of Hennepin as shown on the plat of Hennepin County State Aid Highway no. 6, Plat 5 C.R. Doc No. 3844152; Subject to a highway easement in favor of the City of Plymouth for Ferndale Road over the westerly 33 feet of above described land, as determined in Torrens Case No. 20250, Order Doc. No. 3557568 WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Rachel Contracting for a preliminary and final plat for "Ferndale Terrace", and, FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and, FURTHER, that the following conditions be met prior to recording of, anc related to said plat; A preliminary and final plat is approved to allow the subject property to be subdivided into six lots for single-family dwellings and a base lot to be owned in common, in accordance with the application and plans received by the city on February 27 and April 14, 2014 except as may be amended by this resolution. 2. This preliminary and final plat is approved contingent on approval of a rezoning and Wetland Conservation Act exemption for up to 1,000 square feet of fill. In lieu of the Wetland Conservation Act exemption, the applicant may also submit a wetland replacement plan or documentation considering the wetlands along Ferndale Road to be incidental. 3. Development standards shall be as approved by the PUD general plan. 4. Prior to recording the final plat, the applicant shall: 1) pay the applicable fees for park dedication; 2) receive city approval of a PUD final plan and final construction plans; and 3) execute a development contract and submit related financial guarantees. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Provide HOA documents for the development that include language addressing the following: 1) prohibition of structures and clearing vegetation in wetland buffers and 2) maintenance for common elements including buffer monuments, private drive, driveways, mailboxes, monument signs, shared retaining walls, sidewalks, etc. b. Revise the tree inventory to include the tree inches for the significant cedar on the subject property. c. Indicate all trees disturbed that meet the definition of disturbed, even if they will be saved on the site. d. Revise the landscaping plan to indicate the tree species proposed to be planted on the property. e. Add wetland buffer monuments for the wetlands along Ferndale Road. f Submit an executed, 10 -foot trail and utility easement adjacent to County Road 6. g. Submit an executed encroachment agreement for the retaining walls within the drainage and utility easement for Lot 7, Block 1. h. Show the driveways separated from the private drive by surmountable curb. i. Add fire lane signs in approved locations. j. Add a hydrant at the water main connection to the street water main. k. Add private drive signage with an address range to be installed near the entrance to the private drive. 1. Submit fire flow calculations for the site hydrant. Required gallons per minute and pressure will be based on the total square footage of the largest structure. 6. Prior to grading on the site, tree preservation fencing shall be installed and inspected. The fencing shall be kept out of the drip -line of the cedars on the south side of the property. 7. Standard Conditions: a. With the exception of a model home, no building permits shall be issued until the final plat, HOA documents, agreements, and easements are filed and recorded with Hennepin County. b. Retaining walls over four feet require a building permit and a three-foot fence installed on top. c. The applicant shall be responsible for repairing any damage to the trail along Ferndale Road. d. Compliance with the city's tree preservation regulations. e. All signage shall require separate permits and shall conform to section 21155 of the zoning ordinance. f No trees shall be planted in public rights -of way. g. Removal of all hazardous trees from the property at the owner's expense. h. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the Res. 2014-185 File 2014011 Page 3 property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
