HomeMy WebLinkAboutCity Council Resolution 2012-223CITY OF PLYMOUTH RESOLUTION No. 2012-223 A RESOLUTION APPROVING PRESUMPTIVE PENALTY FOR WANDERING SPIRITS LIQUOR WHEREAS, City ordinance 1206 was violated for a second time within a 36 month period when an underage buyer was sold alcohol by an employee of Wandering Spirits Liquor during a compliance check conducted by the police department on June 21, 2012 and WHEREAS, the first violation for Wandering Spirits Liquor under City ordinance 1206 occurred on November 2, 2011 in which the owner paid a $500 fine and a three day stayed suspension WHEREAS, the presumptive penalty grid established under City ordinance 1206.22 sets forth a fine of $1,000 and a three day suspension and the addition a three additional days that was stayed from the first violation for a total of six day suspension; and WHEREAS, police department case number 12-27087 clearly establishes that the employee at Wandering Spirits was in violation of criminal law by allowing the sale and WHEREAS, police department case number 12-27087 clearly establishes that Wandering Spirits Liquor is responsible for the presumptive penalties set forth in City ordinance 1206.22. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the owner of Wandering Spirits Liquor Vinh Do Nguyen abide by the presumptive penalty in City Code 1206.22 for a second violation within a 36 month period a $1,000 fine and 6 days suspension of alcohol sales. Approved this 24th day of July 2012.
