HomeMy WebLinkAboutCity Council Resolution 2014-237CITY OF PLYMOUTH RESOLUTION 2014-237 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW ACCESSORY RETAIL SALES EXCEEDING TEN PERCENT OF THE TENANT'S FLOOR AREA WITHIN AN EXISITING INDUSTRIAL BUILDING, FOR PROPERTY LOCATED AT 14100 23RD AVENUE (2014047) WHEREAS, New Wave Aquaria, Inc. has requested approval of a conditional use permit to allow accessory retail sales exceeding ten percent of the tenant's floor area within the existing industrial building located at 14100 23rd Avenue, legally described as follows: That part of the Southeast Quarter of the Northwest Quarter of the Northwest Quarter lying westerly of US Highway No. 494, excluding roadway, of Section 27, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by New Wave Aquaria, Inc. for a conditional use permit at 14100 23rd Avenue, subject to the following conditions: 1. A conditional use permit is approved to allow 342 square feet (23.75%) of the applicant's 1,440 square foot leasespace to be used for accessory retail sales, in accordance with the application and plans received by the City on June 6, 2014, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that the proposal complies with the applicable conditional use permit standards. 3. Prior to construction of tenant improvements in the building, the applicant must obtain separate approval of a building permit. 4. Prior to issuance of a building permit, the applicant shall submit an inventory of chemicals and their quantities to be located in the building for review and approval by the city fire inspector. 5. No outdoor storage or sales related to the retail area is permitted with the conditional use permit. Resolution 2014-237 (2014047) Page 2 6. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 7. Standard Conditions: a. Any signage shall require a separate sign permit and shall comply with the city's sign regulations. b. Any subsequent phases or expansions are subject to required reviews and approvals pursuant to ordinance provisions. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
