RESOLUTION No. 2012-191
A RESOLUTION APPROVING A VARIANCE FOR HGA, INC. FOR
HAZELDEN CENTER LOCATED AT 11505 36TH AVENUE (2012040)
WHEREAS, HGA, Inc. has requested approval of a variance to allow installation of two
directional signs that would each contain 14 square feet in area, where the zoning ordinance
specifies a maximum size of 4 square feet for such signs; and
WHEREAS, the subject property is legally described as follows:
That part of Government Lots 1 and 2, Section 23, Township 118, Range 22, Hennepin County,
Minnesota described as follows:
Commencing at the northwest corner of said Government Lot 2; thence on an assumed bearing
of East along the north line of said Government Lot 2 a distance of 1030.00 feet to the point of
beginning of said line; thence South 0 degrees 16 minutes 14 seconds West 600.00 feet; thence
South 45 degrees 32 minutes 37 seconds East 200.00 feet; thence South 31 degrees 17 minutes
42 seconds East 256.86 feet more or less to the east line of said Government Lot 2; thence
southerly along said East line 122.82 feet; thence North 89 degrees 27 minutes 12 seconds East
138.88 feet; thence North 57 degrees 34 minutes 37 seconds East 370.00 feet; thence North 6
degrees 24 minutes 32 seconds West 181.82 feet; thence North 35 degrees 41 minutes 56
seconds East 197.13 feet; thence North 58 degrees 54 minutes 25 seconds West 219.93 feet;
thence North 21 degrees 30 minutes 01 seconds West 190.87 feet; thence North 10 degrees 30
minutes 00 seconds East 255.00 feet more or less to the intersection with the north line of said
Government Lot 1; thence westerly along the north line of said Government Lots 1 and 2 a
distance of 606.66 feet more or less to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by HGA, Inc. for a variance to allow installation of two directional signs that would each
contain 14 square feet in area, where the zoning ordinance specifies a maximum size of 4 square
feet for such signs, subject to the following findings and conditions:
1. The requested variance is hereby approved, in accordance with the application and plans
received by the City on May 30, 2012, except as may be amended by this resolution.

2. The requested variance is approved, based on the finding that all applicable variance
standards have been met. Specifically,
a. The variance and resulting signage would be in harmony with the general purposes and
intent of the ordinance, and would be consistent with the city's comprehensive plan.
b. The applicant has demonstrated that, in this particular case, there are practical
difficulties in complying with the size limitation for directional signs, because:
1. The proposed signs are reasonable and would allow the landowner to use the
property in a reasonable manner;
2. the request is due to circumstances not created by the landowner; and
3. the variance would not alter the essential character of the site or properties.
c. The requested variance is not based upon economic considerations, but rather, is based
upon a desire to assist in wayfinding for people driving within the site.
d. The variance and resulting signage would not be detrimental to the public welfare, nor
would it be injurious to other land or improvements in the neighborhood. The subject
directional signage would not be readily visible off the site.
e. The variance and resulting signage would not impair an adequate supply of light and air
to adjacent properties, nor would it increase traffic congestion or the danger of fire,
endanger the public safety, or substantially diminish property values within the
neighborhood.
f. The variance requested is the minimum action required to address the practical
difficulties. The remainder of the signage proposed for the site would comply with all
city regulations.
3. A sign permit is required prior to installation of the signs.
4. The variance shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project, or unless the applicant, with
the consent of property owner, has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21030.06 of the
Zoning Ordinance.
