RESOLUTION No. 2012-190
A RESOLUTION APPROVING A SIGN VARIANCE FOR IMAGINALITY DESIGNS FOR PARK
PLACE APARTMENTS LOCATED AT 34TH AVENUE AND FERNBROOK LANE (2012035)
WHEREAS, Imaginality Designs has requested approval of a variance to allow
installation of a third area identification sign where the zoning ordinance allows two; and
WHEREAS, the subject property is legally described as follows:
Lots 1, 2, and 3, Block I and Lot 1, Block 2, Park Place, according to the recorded plat
thereof, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Imaginality Designs for a variance to allow installation of a third area identification
sign where the zoning ordinance allows two, subject to the following findings and conditions:
I. The requested variance is hereby approved, in accordance with the application and plans
received by the City on May 18 and June 11, 2012, except as may be amended by this
resolution.
2. The requested variance is approved, based on the finding that all applicable variance
standards have been met. Specifically,
A. The requested variance would be in harmony with the general purposes and intent of the
ordinance, and would be consistent with the city's comprehensive plan.
B. The applicant has demonstrated that there are practical difficulties in complying with the
limitation, because:
I The applicant proposes to use the property in a reasonable manner.
II The property has unique circumstances that were not created by the applicant
including the size of the property and layout of the site. The property is 35.5 acres.
The property is divided by 34th Avenue and the office is located within a separate
building.
III The variance would not alter the essential character of the lot or surrounding area.
C. The requested variance is not based exclusively upon economic considerations.

D. The variance would not impair an adequate supply of light and air to adjacent properties,
nor would it increase traffic congestion or the danger of fire, endanger the public safety,
or substantially diminish property values within the neighborhood. The area
identification sign would assist visitors to find the club house/office building with fewer
sudden stops and less backtracking.
E. The variance requested is the minimum action required to address the practical
difficulties. The surface area for the three area identification signs proposed does not
exceed that allowed without the variance.
3. A sign permit is required prior to installation of the sign.
4. The combined total of the three area identifications signs allowed for the property shall not
exceed 64 square feet.
5. The variance shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project, or unless the applicant, with
the consent of property owner, has received prior approval from the city to extend the
expiration date for up to one additional year, as regulated under section 21030.06 of the
Zoning Ordinance.
