RESOLUTION No. 2012-171
A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR GWS
LAND DEVELOPMENT OF PLYMOUTH LLC. FOR "TERRA VISTA" FOR PROPERTY
LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF DUNKIRK LANE AND
COUNTY ROAD 47 (2011095F)
WHEREAS, GWS Land Development of Plymouth, LLC. has requested approval of a final
plat for 54 new single-family lots, one HOA amenity lot and three outlots on the roughly 60 -acre
parcel presently legally described as follows:
All of the Northeast Quarter of Section 5, Township 118, Range 22, lying westerly of the
west line of the East 5/8 of the Northeast Quarter of Section 5, Township 118, Range 22,
and lying southerly of the right of way of County Road No. 47, Hennepin County,
Minnesota
And
That part of the Northeast Quarter of Section 5, Township 118, Range 22 described as
commencing at the northwest corner of the South 1530 feet of the East 759 feet of said
Northeast Quarter; thence on an assumed bearing of South 00 degrees 02 minutes 02
seconds West along the west line of said East 759 feet of the Northeast Quarter a distance
of 22 feet to the point of beginning; thence South 70 degrees 24 minutes 32 seconds West a
distance of 170.33 feet; thence South 00 degrees 11 minutes 40 seconds West a distance of
318.76; thence South 70 degrees 26 minutes 22 seconds West a distance of 757.87 feet to
the west line of the East 5/8 of said Northwest Quarter; thence South 00 degrees 11 minutes
58 seconds West a distance of 883.16 feet to the southwest corner of said East 5/8 of the
Northeast Quarter; thence North 89 degrees 32 minutes 29 seconds East along the south
line of said Northeast Quarter a distance of 885.40 feet to the west line of said East 759 feet
of the Northeast Quarter; thence North 00 degrees 02 minutes 02 seconds East along said
west line of said East 759 feet of the Northeast Quarter a distance of 1508 feet to the point
of beginning, Hennepin County, Minnesota
And
The South 30 feet of the East 759 feet of said Northeast Quarter, Hennepin County,
Minnesota.
WHEREAS, city staff has prepared a development contract covering the improvements
related to said plat.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by GWS Land Development of Plymouth, LLC. for a final plat for "Terra
Vista"; and
FURTHER, that the development contract for said plat be approved, and that upon prior
execution of the development contract by the developer, the mayor and city manager be
authorized to execute the development contract on behalf of the city; and
FUTHER, that the following conditions be met prior to recording of, and related to said
plat:
1. The final plat for Terra Vista is approved in accordance with the plans received by the city on
April 5 and 12, 2012, except as may be amended by this resolution.
2. Prior to disturbance of wetland 2 or prior to and in conjunction with approval of the
final plat for phase 2, the applicant shall obtain approval of a wetland replacement plan.
3. Prior to commencement of trading activity, the applicant shall install and request
inspection of silt fencing and tree preservation fencing.
4. Prior to recording the final plat, the applicant shall execute the development contract for
the public and private improvements, and shall submit the required financial guarantees.
5. Prior to recording the final plat, the applicant shall provide the following easements, deeds,
permits and agreements:
a. An easement for trail snow storage along and adjacent to the County Road 47 right-of-
way.
b. An encroachment agreement for retaining walls in the drainage and utility easements in
Lots I and 2, Block 4; Lot 1, Block 5; and Lot 1, Block 6.
c. Access easements are required for all access routes to storm water ponds and off-road
sanitary sewer if not in drainage and utility easements.
d. A maintenance agreement for the infiltration basins.
e. Temporary grading and constriction easements for the turnarounds at the terminus of
Zanzibar Lane and 59"' and 60"' Avenues.
f. Temporary grading easements to connect the existing driveways to Dunkirk Lane.
g. A temporary constriction easement for the sanitary sewer in Blocks 2 and 3 or move the
sewer main farther from the property line.
h. Provide HOA documents for the development that include language addressing the
following: 1) prohibition of strictures and clearing vegetation in wetland buffers and 2)
maintenance for common elements including buffer monuments, fire lane (including

removal), median plantings, mailboxes, monument signs, shared retaining walls, sidewalks,
etc.
i. Provide the following permits: Minnesota Pollution Control Agency; Minnesota
Department of Health (watermain extension and well abandonment), NPDES; and
Hennepin County (work in the County Road 47 right-of-way and on-site sewage system
abandonment).
6. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the
required information, and revise the plans as indicated below, consistent with the applicable
city code, zoning ordinance, and engineering guidelines:
a. Submit amended fire flow calculations excluding the hydrant on the County Road 47
watermain.
b. Remove the driveway encroachment from 5825/5875 Vicksburg Lane in Outlot A.
c. Revise the drawings to demonstrate that the driveways on corner lots would be in
compliance with the 40 -foot driveway setback as measured from the intersection of
property lines.
d. Revise the plat to remove 1) outlot B and consider it right-of-way and 2) outlot C and
combine with outlot A.
e. Revise the grading and erosion control plans as follows:
(1) Remove the existing field entrance and culvert off County Road 47.
(2) Provide side lot drainage swales for Lots 3 and 4, Block 1 and Lot 24, Block 3.
(3) Retaining walls may be required in Outlot A to protect the adjacent driveway on
properties 5825/5875 Vicksburg Lane.
f. Revise the final constriction plans to include the stormwater protection plan. The plan
shall include all the responsible parties and their contact information.
g. Revise the tree preservation plan to indicate tree preservation fencing protecting trees
1209-1216 and 1472 or consider them disturbed.
h. Revise the street and utility plans as follows:
(1) Combine street name signs and stop signs (typ. all sheets).
(2) Add detail SS -9 for Off -Road Utilities Access Drive, to the detail sheets.
(3) Add street names in the plan and profile on sheets 11 through 16.
(4) Shift the driveways out of side yard drainage and utility easements on Lots 1-12, 18,
and 19, Block 3.
(5) Provide a temporary hydrant and plug on Dunkirk Lane at the terminus of the
watermain.
(6) Strengthen (tie back) all the vertical bends on 59"' Avenue at approximate station
1+00.
(7) Remove two tees and use a cross for the watermain at the intersection of 59"'
Avenue and Zanzibar Lane.
(8) Use SDR -26 polyvinyl chloride pipe between manholes 21 and 22.
(9) Correct the depth (build) shown for the sanitary manhole 2.
(10) Move manhole 10 to the centerline of 59"' Avenue and Comstock Lane and manhole
nine 45 feet west to the centerline of 59"' Avenue.

(11) Move the tee at 59"' Avenue and Black Oaks Lane to be 10 feet off the centerline of
59"' Avenue.
(12) Add notes to 1) strengthen (tie) the last six joints at apron A2, B2 and C1 and 2)
strengthen (tie) all joints between storm sewer manhole D3 and apron D2 and outlet
strictures OS -1, OW -2 and OS -5.
(13) Move the label E-4 off the stricture numbers in the profile on sheet 21.
7. Prior to the issuance of a building permit, the applicant shall submit a survey indicating:
a. A minimum of two front yard trees to be preserved or planted, and
b. Silt fence and tree preservation fencing installed consistent with city code.
8. Prior to issuance of building permits for Lots 1-4, Block 1 and Lot 1, Block 7, the
applicant and the adjacent property owner at 5915 Dunkirk Lane shall vacate easements for
existing Dunkirk Lane. Existing utilities in the existing Dunkirk Lane corridor shall be
relocated.
9. Prior to issuance of a building permit for Lot 13, Block 3, the applicant shall submit a
geotechnical report to address wetland fill. The report shall be prepared by a certified
engineer licensed by the State of Minnesota.
10. Standard Conditions:
a. Development standards and setbacks for this plat shall comply with the RSF-3 zoning
standards. No variances are granted or implied.
b. No trees shall be planted in the boulevard.
c. With the exception of model homes, no building permits shall be issued until the final plat,
agreements, and easements are filed and recorded with Hennepin County.
d. Compliance with the city's tree preservation regulations.
e. Removal of all hazardous trees from the property at the owner's expense.
f. Any signage shall require separate permits and shall comply with the city's signage
regulations.
g. This approval shall expire two year after the date of approval, unless the property owner
or applicant has recorded the final plat, or unless the property owner or applicant has
received prior approval from the city to extend the expiration date for up to one additional
year, as regulated under section 512 of city code.
