RESOLUTION No. 2014-205
A RESOLUTION APPROVING A PRELIMINARY PLAT FOR U.S. HOME CORPORATION DBA
LENNAR FOR "BROCKTON EAST" FOR PROPERTY LOCATED AT 4640 TO
4420 BROCKTON LANE (2013111)
WHEREAS, U. S. Home Corporation dba Lennar has requested approval of a preliminary plat
for the roughly 27 -acre parcel presently legally described as follows:
PARCEL 1: The West 586.84 feet of the Southwest 1/4 of the Southwest 1/4 of Section 7,
Township 118 North, Range 22 West of the 5th Principal Meridian, Hennepin County,
Minnesota, except that part thereof described as follows: The East 128.06 feet of the West
586.84 feet of the North 185.3 feet and the North 33 feet of the West 243.5 feet;
PARCEL 2: That part of the Northwest 1/4 of Northwest 1/4 of Section 18, Township 118
North, Range 22 West of the 5th Principal Meridian, Hennepin County, Minnesota, described as
follows: Commencing 711.55 feet west of the Northeast corner of said Northwest 1/4 of
Northwest 1/4; thence West 586.84 feet to the Northwest corner of said Section; thence South
along the West line of said Section 187.26 feet to a point 1141.74 feet North of the Southwest
corner of Northwest 1/4 of Northwest 1/4, 586.84 feet to a point 714.16 feet West of the East line
of said Northwest 1/4 of Northwest 1/4; thence North 181.5 feet to beginning:
Except the following conveyed to the Town of Plymouth by Warranty Deed dated May 24, 1924
and filed June 2, 1924 as Document No. 1215446: A strip of Land Sixteen (16) feet in width
running North and South along the West line of the Southwest Quarter (SWI/4) of the Southwest
Quarter (SWI/4) of Section Seven (7), Township One Hundred and Eighteen (118), Range
Twenty Two (22), also a strip of land Sixteen (16) feet wide running along the West line of the
Northwest Quarter (NW1/4) of the Northwest Quarter (NW1/4) of Section 18, Township One
Hundred and Eighteen (118), Range Twenty Two (22), Hennepin County, Minnesota.
PARCEL 3: The North 283.19 feet of the South 1141.74 feet of the Northwest Quarter of the
Northwest Quarter of Section 18, Township 118, Range 22, excepting therefrom the West 16
feet, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by U. S. Home Corporation dba Lennar for a preliminary plat for `Brockton East",
subject to the following conditions:

1. A preliminary plat is approved to allow the property to be subdivided into 25 single-family
lots, in accordance with the application and plans received by the city on November 14,
2013, February 20 and 27, March 28 and April 11, 2014, except as may be amended by this
resolution.
2. Approval of the preliminary plat is contingent upon City Council approval of the
comprehensive plan amendment, rezoning the site to RSF-3 and a spring verification of the
wetland delineation report.
3. No private driveway access from any lot shall be permitted to Brockton Lane.
4. Prior to recording the final plat, the applicant shall: 1) receive city approval of final
construction plans; 2) execute a development contract and submit related financial guarantees
and 3) remove the house on 4420 Brockton Lane and all accessory buildings and fences.
5. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the
required information, and revise the plans as indicated below, consistent with the applicable
city code, zoning ordinance, and engineering guidelines:
(1) Provide HOA documents for the development that include language addressing the
following: 1) prohibition of structures and clearing vegetation in wetland buffers and 2)
maintenance for common elements including buffer monuments, median plantings,
mailboxes, monument signs, shared retaining walls, sidewalks, etc.
(2) Submit an executed 10 -foot trail easement adjacent to the Brockton Lane right-of-way.
(3) Submit fire flow calculations and provide the total square footage of the largest
proposed structure.
(4) Revise the plat to include the entire parcel for 4640 Brockton Lane. Assign the parcel
north of the creek to a separate lot. Park dedication and tree preservation requirements
shall apply to the parcel north of the creek when development is proposed.
(5) Revise the plans to show the driveways 40 feet from intersections.
(6) Add the high water level of all ponds and wetlands and indicate that all homes have a
lowest floor elevation a minimum of two feet above the high water level.
(7) Revise the plans based on the outcome of the spring wetland delineation.
(8) Revise the buffer monuments to add and relocate to approved locations.
(9) Submit an easement for any temporary cul-de-sac that may be necessary.
(10) Provide interpretive signage for the trail within the wetland buffer.
(11) Provide a trail centered within a 20 -foot easement connecting 44th Avenue with the trail
proposed along the wetland. An executed trail easement is required for all trails in the
subdivision.
(12) Revise the grading plan to show the direction of rear yard drainage and re -grade the rear
yards as necessary to avoid increasing the rate or volume of stormwater run-off flowing
east through the Arbor Grove subdivision and to add an emergency overflow swale
behind Lots 7, 8 and 9 to the pond behind lot 17.
6. Prior to the issuance of a building permit, the applicant shall submit a survey indicating:

a. A minimum of two front yard trees to be preserved or planted, and
b. Silt fence and tree preservation fencing installed consistent with city code.
7. Standard Conditions:
a. With the exception of a model home, no building permits shall be issued until the final
plat, agreements, and easements are filed and recorded with Hennepin County.
b. No trees shall be planted in the boulevard.
c. Signs shall require a separate permit and comply with section 21155 of the zoning
ordinance.
d. Retaining walls over four feet require a separate building permit and are required to have
a three-foot fence installed on top.
e. Compliance with the city's tree preservation regulations.
f. Removal of all hazardous trees from the property at the owner's expense.
g. This approval shall expire one year after the date of approval, unless the applicant has
applied for final plat approval, or unless the applicant, with the consent of the property
owner, has received prior approval from the city to extend the expiration date for up to
one additional year, as regulated under section 510 of city code.
