HomeMy WebLinkAboutCity Council Resolution 2014-186CITY OF PLYMOUTH RESOLUTION No. 2014-186 A RESOLUTION APPROVING A PUD GENERAL PLAN FOR FERNDALE TERRACE ON PROPERTY LOCATED AT THE SOUTHEAST CORNER OF COUNTY ROAD 6 AND FERNDALE ROAD (2014011) WHEREAS, Rachel Contracting has requested approval of a PUD general plan for the property legally described as follows: That part of government lot 6, section 30, township 118, range 22, lying westerly of the west line of Hunter's Bluff and its northerly extension, which lies between the north line of the south 30 feet of said government lot 65 and a line drawn easterly at an angle of 87 degrees 15 minutes, measured south to east from a point on the west line of said government lot 6 distant 358.38 feet northerly from the southwest corner of said section 30. Subject to a highway easement in favor of the County of Hennepin as shown on the plat of Hennepin County State Aid Highway no. 6, Plat 5 C.R. Doc No. 3844152; Subject to a highway easement in favor of the City of Plymouth for Ferndale Road over the westerly 33 feet of above described land, as determined in Torrens Case No. 20250, Order Doc. No. 3557568. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by Rachel Contracting for a PUD general plan, subject to the following conditions: A PUD general plan is approved to allow six single-family dwellings, according to the plans received by the city on February 27 and April 14, 2014, except as amended by this resolution. 2. Approval of this PUD general plan is contingent on approval of the rezoning and Wetland Conservation Act exemption for up to 1,000 square feet of fill. In lieu of the Wetland Conservation Act exemption, the applicant may also submit a wetland replacement plan or documentation considering the wetlands along Ferndale Road to be incidental. 3. Development standards shall be as indicated on the plans and materials dated February 27 and April 14, 2014, except as amended by this resolution. 4. The RSF-4 setbacks shall apply to all structures, except as noted: a. Garages shall be setback 22 feet from the surmountable curb for the private drive. b. Buildings shall be setback 15 feet from the wetland buffers, except that uncovered decks and at -grade patios may be located up to nine feet from the wetland buffers. c. Other structures and improvements shall be reviewed consistent with section 21115.04 of the zoning ordinance. 5. No building permits shall be issued until a PUD final plan is approved by city staff. Prior to approval of the PUD final plan, the applicant shall submit revised plans consistent with the conditions in the resolution approving the preliminary plat. 7. A portion of the financial guarantee for landscaping shall be held for two years after the homes are constructed to guarantee replacement of any multi -trunk cedar that die within the mature hedgerow along the south side of the property. Replacements shall be of similar specie and a minimum of eight -feet at planting. 8. All signage shall require separate permits and shall be in conformance with section 21155 in the zoning ordinance.
