HomeMy WebLinkAboutCity Council Resolution 2014-180CITY OF PLYMOUTH RESOLUTION 2014-180 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO REPLACE AN EXISTING LIGHT POLE WITH A DUAL-PURPOSE MONOPOLE FOR LIGHTING AND CELLULAR ANTENNAS AT WAYZATA CENTRAL MIDDLE SCHOOL, 305 VICKSBURG LANE (2014022) WHEREAS, AT&T has requested approval of a conditional use permit to allow replacement of an existing 71 -foot high light pole with a 75 -foot high dual-purpose monopole for lights and cellular antennas for property located at 305 Vicksburg Lane, legally described as follows: The Southeast Quarter of the Southeast Quarter; the South 535.4 feet of the Northeast Quarter of the Southeast Quarter; and the South 535.4 feet of the East 10 acres of Government Lot 7, all in Section 32, Township 118, Range 22, subject to all easements of record for road purposes over the strip of land 1 rod wide North of the South line of said above described Southeast Quarter of the Southeast Quarter of Section 32, Township 118 North, Range 22; and subject to all public roadways now existing on said property to wit: a town road over the East 33 feet of the Southeast Quarter of Section 32, Township 118 North, Range 22; and County Road 15; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by AT&T for a conditional use permit at 305 Vicksburg Lane, subject to the following conditions: 1. A conditional use permit is approved to allow replacement of the existing 71 -foot high light pole located in the southwest portion of the track/athletic field with a 75 -foot high dual- purpose monopole for lights and cellular antennas, together with related ground equipment, as shown on the application and plans received by the City on April 1, 2014, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that the proposal complies with the applicable conditional use permit standards. 3. The project requires a separate building permit prior to installation of the monopole and equipment. Resolution 2014-180 (2014022) Page 2 4. Prior to issuance of a building permit, the applicant shall 1) submit a Material Safety Data Sheet (MSDS) and quantities of any hazardous materials used or stored on the site; 2) revise the plans to indicate the monopole would have a silver -colored galvanized steel finish to match the other light poles; and 3) indicate that the affected areas would be restored to pre -construction conditions. 5. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Any subsequent phases or expansions are subject to required reviews and approvals pursuant to ordinance provisions. 6. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
