HomeMy WebLinkAboutCity Council Resolution 2014-179CITY OF PLYMOUTH RESOLUTION No. 2014-179 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR GW LAND DEVELOPMENT OF PLYMOUTH, LLC FOR "MJP PARCELS" FOR PROPERTY LOCATED AT 5600, 5630, AND 5700 DUNKIRK LANE (2014018) WHEREAS, GW Land Development of Plymouth, LLC has requested approval of a preliminary plat for roughly 30 acres of land presently legally described as follows: The South Quarter of the Northwest Quarter of the Southeast Quarter of Section 5, Township 118, Range 22, West of the 5t" Principal Meridian, Hennepin County, Minnesota. AND The North Half of the South Half of the Northwest Quarter of the Southeast Quarter of Section 5, Township 118, Range 22, Hennepin County, Minnesota. AND The South Half of the North Half of the Northwest Quarter of the Southeast Quarter of Section 5, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by GW Land Development of Plymouth, LLC for a preliminary plat for MJP Parcels, subject to the following conditions: 1. A preliminary plat is approved for 59 single-family lots and one amenity lot, in accordance with the plans received by the city on March 14, 2014, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site. 3. Prior to commencement of grading operations, the developer shall install and request inspection of tree preservation fencing and silt fencing. 4. Prior to recording the final plat, the developer shall: Res. 2014-179 File 2014018 Page 2 a) Remove the existing structures from the site. Demolition permits are required for removal of existing structures. b) Provide a separate ten -foot wide trail easement along the west side of those properties that abut Dunkirk Lane. c) Execute the development contract and provide the related financial guarantees and fees. d) Receive city approval of final construction plans. e) Design the emergency overflow (EOF) for Pond B in a manner that ensures there would be no drainage or flooding issues for future trails in the Northwest Greenway. f) Obtain a drainage easement for the area of Pond B that would be located on the Northwest Greenway. The drainage easement area will be deducted from the park dedication credit to be given for the trail outlot (Outlot A). e) Dedicate and convey Outlot A to the city by warranty deed, free and clear of any and all encumbrances. 5. Prior to issuance of building permits for lots abutting wetlands, permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. 6. Prior to issuance of building permits for lots that abut the Northwest Greenway, the developer shall install parkland signs/monuments to delineate the park property, in locations as required by the City Parks Department. 7. The developer shall install a city trail segment between Blocks 1 and 2 and between Lots 6 and 7 of Block 3 (as shown on the preliminary plat) prior to issuance of building permits on the abutting lots. 8. The developer shall notify potential buyers about future roadway extensions and about the future street improvement projects for Dunkirk and Vicksburg Lane. 9. In conjunction with submission of the final plat application, the developer shall submit homeowner's association documents for city review. The homeowner's association documents shall address: a) responsibilities for maintenance and repair of the amenity lot (swimming pool area), developer - installed retaining walls, wetland buffers, buffer monuments, sidewalks, landscaped median island at the site entrance (57th Avenue near Dunkirk Lane), and any other similar or common features, and b) prohibition on structures and the clearing of native vegetation from the wetland buffers. 10. The stub street and utilities shall be constructed to the south plat boundary. A temporary cul-de- sac turn -around will not be required at the end of that street if the street is barricaded near the intersection of 56th Avenue and the street segment shown as 56th Court (56th Court will be named Comstock Lane on the final plat). 11. Construction access to Dunkirk Lane may be limited or restricted during the Dunkirk Lane reconstruction project. 12. The developer shall relocate the sidewalk to the east/south side of the street segment shown as Archer Lane/561h Avenue (Archer Lane will be named Zanzibar Lane on the final plat). The trail shall Res. 2014-179 File 2014018 Page 3 continue to be paved to the street curb (for the area between the sidewalk and the curb) with no pedestrian ramp in that location. 13. The developer shall install roughly 50 feet of sidewalk along the front of Lot 1, Block 2 (as shown on the preliminary plat) to connect the city trail in Outlot A with the sidewalk on the west side of the street segment shown as Black Oaks Lane (Black Oaks Lane will be named Archer Lane on the final plat). A pedestrian ramp shall be provided at the east end of the sidewalk where it enters the street. The trail shall continue to be paved to the street curb with no pedestrian ramp in that location. 14. Standard Conditions: a. Except as otherwise may be allowed for model homes, no building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. c. Any signage shall require separate permits and shall comply with the city's sign regulations. d. The sidewalks along all streets shall be installed at the same time the streets are installed. e. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. f. Compliance with the city's tree preservation regulations. g. Removal of all hazardous trees at the owner's expense. h. Except for the landscaped median island at the site entrance (57th Avenue near Dunkirk Lane), no trees shall be planted in the boulevard. i. This approval shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
