HomeMy WebLinkAboutCity Council Resolution 2014-126CITY OF PLYMOUTH RESOLUTION No. 2014-126 A RESOLUTION APPROVING A SITE PLAN AMENDMENT AND VARIANCES FOR LEN BUSCH ROSES AT 4045 COUNTY ROAD 101 (2014009) WHEREAS, Len Busch Roses, has requested approval of a site plan amendment and variances to allow alterations to the building, loading, and parking at 4045 County Road 101; and WHEREAS, the subject property is legally described as follows: The south half of the southwest quarter of the northeast quarter and the north two rods of the north half of the northwest quarter of the southeast quarter in Section 18, Township 118, Range 22, Hennepin County, except the north 238.7 feet of the east 208.7 feet of said south half of the southwest quarter of the northeast quarter, according to the United States Government survey thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for a site plan amendment and variances to allow alterations to building, loading and parking for Len Busch roses at 4045 County Road 101, subject to the following conditions and findings: 1. A site plan amendment is approved to allow the following: a) parking lot modifications on the south side of the building; b) a truck turnaround area on the south side of the drive -aisle; and c) a dock and building expansion in the southeast corner of the building, in accordance with the application and plans received by the city on March 14, 2014, except as may be amended by this resolution. 2. Variances are approved to allow: 1) a non -conforming building to be expanded to accommodate a 540 -square foot addition to a loading/receiving area and to allow the addition to be 22.8 feet from the Hamel Road right-of-way where the ordinance requires 100 feet and 2) a non -conforming loading area to be expanded in a front yard to be 15 -feet where the ordinance requires 30 -feet, based on the finding that all applicable variance standards have been met. Specifically, that the construction of Hamel Road creates practical difficulties to use the existing dock and that the circumstances are unique and based on constructing a road across developed property. 3. No site alteration may occur prior to the issuance of applicable permits. Resolution 2014-126 (2014009) Page 2 4. Prior to issuance of building or grading permits, the following items shall be submitted or revised consistent with the zoning ordinance, city code and engineering guidelines: a. The applicant shall submit an executed site improvement performance agreement for completion of the proposed site improvements. b. The applicant shall revise the plans to indicate the following information: i. An eight -foot screen fence above the retaining walls on the east side of the loading area and the south side of the truck maneuvering area. ii. Parking spaces a minimum of nine feet wide by 18.5 feet long. iii. Drive aisle a minimum of 24 feet in width. 5. Materials and colors proposed for the new loading/receiving expansion shall be consistent with the existing building. 6. Parking spaces shall be striped so that no portion of the spaces is closer than five feet from the building. 7. Standard Conditions: a. Any signage shall comply with the signage regulations and applicable sign permits are required prior to installation. b. Trash and recycling storage shall be in compliance with the zoning ordinance. c. The site plan amendment and variances shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21030.06, respectively, of the zoning ordinance.
