RESOLUTION NO. 2012-086
A RESOLUTION APPROVING PURCHASE AGREEMENT BETWEEN
HAMPTON HILLS INVESTMENT, LLC AND THE CITY OF PLYMOUTH
FOR PROPERTY ON POMERLEAU LAKE
WHEREAS, the City of Plymouth ("City") is proposing to acquire property
legally described in the attached Exhibit "A," ("Subject Property") under the terms of
the proposed purchase agreement between the City and Hampton Hills Investment,
LLC ("Developer") attached hereto and incorporated herein as Exhibit "B," ("Purchase
Agreement"), and;
WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning
Commission review the City's proposed acquisition of real property for compliance
with the comprehensive plan and to report to the City Council in writing its findings,
and;
WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the
requirement for review by the Planning Commission upon 2/3 vote of the City Council
dispensing with the requirement and finding that the acquisition or disposal of the real
property has no relationship to the comprehensive municipal plan; and
WHEREAS, the Director of Parks and Recreation has negotiated a purchase
price of $200,000 for said property, and
WHEREAS, the City Council has reviewed said purchase agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the purchase
agreement between the City of Plymouth and Hampton Hills Investment, LLC is
hereby approved, and fiirther, that fiinding will be taken from park dedication fiinds,
and fiirther, that the park dedication fiinds will be reimbursed from future bond
referendum proceeds, and fiirther, that the Mayor and City Manager are authorized
to sign the purchase agreement.
