FOR "TERRA VISTA" FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF DUNKIRK LANE AND COUNTY ROAD 47 (2011095) WHEREAS, GWS Land Development of Plymouth has requested approval of a preliminary plat for the roughly 60 -acre parcel presently legally described as follows: PARCEL I: All of the Northeast Quarter of Section 5, Township 118, Range 22, lying westerly of the west line of the East 5/8th of the Northeast Quarter of Section 5, Township 118, Range 22, and lying southerly of the right-of-way of County Road 47, Hennepin County, Minnesota. PARCEL 2: Commencing at the northwest corner of the south 1530 feet of the east 759 feet of the Northeast Quarter of Section 5, Township 118 North, Range 22; thence on an assumed bearing of South 00 degrees 00 minutes 12 seconds West along the west line of said east 759 feet of Northeast Quarter a distance of 22 feet to the point of beginning; thence South 70 degrees 24 minutes 32 seconds West a distance of 170.43 feet; thence South 00 degrees 09 minutes 50 seconds West a distance of 318.76 feet; thence South 70 degrees 24 minutes 32 seconds West a distance of 757.87 feet to the west line of the East 5/8th of said Northeast Quarter; thence South 00 degrees 09 minutes 50 seconds West along said west line of the East 5/8th a distance of 883.16 feet to the southwest corner of said East 5/8th of Northeast Quarter; thence North 89 degrees 29 minutes 36 seconds East along the south line of said Northeast Quarter a distance of 885.40 to the west line of said east 759 feet of Northeast Quarter; thence North 00 degrees 00 minutes 12 seconds East a distance of 1508 feet to the point of beginning, Hennepin County, Minnesota. Also: The south 30 feet of the East 759 feet of said Northeast Quarter, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does Res. 2012-075 File 2011095 Page 2 approve the request by GWS Land Development of Plymouth, LLC. for a preliminary plat for "Terra Vista", subject to the following conditions: 1. A preliminary plat is approved to allow the property at the southeast corner of the intersection of Dunkirk Lane and County Road 47 to be subdivided into 128 single-family lots, in accordance with the application and plans received by the city on November 29, 2011 and January 20, 2012, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site to RSF-3. 3. Prior to issuance of a 2radin2 permit or prior to and in conjunction with approval of the final plat, the applicant shall obtain approval of a wetland replacement plan. 4. Prior to issuance of a 2radin2 permit, the applicant shall install and request inspection of silt fencing and tree preservation fencing. 5. Prior to recording the final plat, the applicant shall pay the park dedication cash fee with credit for land to be dedicated for trail outlots, in accordance with the ordinance in effect at the time the final plat is recorded. 6. Prior to final platting, the applicant shall fiilfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Assessment/right-of-way/easement/agreement/permit requirements: (1) Payment of water and sanitary sewer area charges. (2) Provide HOA documents for the development that include language addressing the following: 1) prohibition of strictures and clearing vegetation in wetland buffers and 2) maintenance for common elements including buffer monuments, fire lane (including removal), median plantings, mailboxes, monument signs, shared retaining walls, sidewalks, etc. (3) Vacate existing Dunkirk Lane where re -aligned. Existing utilities in the corridor shall be relocated. (4) Provide a drainage and utility easement for the culvert discharge from Wetland 2 and for the constriction of a driveway culvert adjacent to Lots 1 and 10, Block 3. (5) Provide access easements for all access routes to storm water ponds and off-road sanitary sewer. (6) Provide temporary easements for grading purposes to constrict improvements at the ends of 59"' Avenue, 60"' Avenue, and Zanzibar Lane. (7) Provide temporary easements for grading purposes to constrict connections to existing driveways on Dunkirk Lane. (8) Provide a temporary constriction easement for sanitary sewer constriction in Blocks 2 and 3. Res. 2012-075 File 2011095 Page 3 (9) Execute encroachment agreements for retaining walls to be located in drainage and utility easements. (10) Execute maintenance agreements for the infiltration basins. (11) Provide the following permits: Minnesota Pollution Control Agency; Minnesota Department of Health (for water main extensions and well abandonment); Elm Creek Watershed; NPDES; Hennepin County (work in the County Road 47 right-of-way and on-site sewage system abandonment); and City of Plymouth right-of-way permits. (12) Submit fire flow calculations with each phase of the development. (13) Amend the fire flow calculations for the development to remove the hydrant on the County Road 47 water main and flow the highest elevation hydrant on the most remote dead-end water main. The hydrant must flow a minimum of 2,250 gallons per minute at 20 psi residual pressure. b. Plat/site plan: (1) Combine outlot A with an adjacent lot. (2) Revise other plans sheets to be consistent with 1) the lot width proposed for outlot C and 2) the letter designations of the outlots. (3) Provide a public street connection to 5915 Dunkirk. The right-of-way shall align with 59t11 Avenue as shown in the Exhibit submitted February 28, 2012. c. Grading and erosion control plans: (1) Add wetland buffer monuments to Wetland 2 as required by section 21670 of the zoning ordinance. (2) Indicate the wetland buffer for Wetland 4 with the maximum buffer where the grades exceed 12 percent. (3) Indicate maintenance access to all ponds, filtration basins and sanitary manholes (except manhole 5) located outside of street right-of-way. Access routes shall have a minimum width of 15 feet with a 12 -foot wide driving surface, a maximum slope of 10 percent and a maximum cross slope of 3 percent per detail 22-9. (4) Remove the existing field entrance and culvert off County Road 47 and replace the culvert under Dunkirk Lane. (5) Provide side lot drainage swales for Lots 1-4, Block 1; Lot 24, Block 3; and Lots 3- 5, Block 5. (6) Consider revising the building pad elevations for Lot 1, Block 1; Lot 21, Block 3; Lot 3, Block 6; and Lots 8 and 26, Block 8 to avoid excessively steep or flat driveway grades. (7) Raise the low floor elevations or adjust grading for Lot 5, Block 2; Lot 5, Block 4; Lots 2, 11 and 12, Block 8; and Lots 2, 3, 6, 8 and 9, Block 9. (8) Verify that the grading for Lot 9, Block 4 and Lot 1, Block 5 requires removal of a gravel driveway encroachment from the adjacent property. (9) Retaining walls may be required on the east side of Lot 9, Block 4 and Lot 1, Block 5. (10) Lower the grades between station 55+00 and station 59+00 on Dunkirk Lane to accommodate drainage from existing driveways. Res. 2012-075 File 2011095 Page 4 (11) Additional erosion control measures are required for the drainage way in the backyard area of Lots 1-10, Block 7. d. Street and utility plans: (1) Revise the plans to indicate the Dunkirk Lane trail constricted five feet from the curb. (2) Improve Dunkirk Lane to a 32 -foot wide (minimum) minor collector roadway the fiill length of the plat with the second phase of the development. Indicate that Dunkirk Lane will be constricted to STA 61+50 with the first phase. (3) Identify the storm sewer outlet on the south end of Dunkirk Lane. (4) Extend the sanitary sewer stub past the storm sewer on the north end of Road 7. (5) Move the storm sewer manhole J2 out of the boulevard and into the street. (6) Add a gate valve to the 16 -inch water main on the east side of the 12 -inch connection at Dunkirk Lane. (7) Provide an eight -inch water main stub for the hydrant shown at station 58+40 on Dunkirk Lane. (8) Provide an 8 -inch water main stub to the west side of Dunkirk Lane in the vicinity of station 61+00. (9) Extend the 12 -inch water main in Dunkirk Lane to the south plat boundary and add a valve at the south end of the main. (10) Install an eight -inch water main in outlot E to Vicksburg Lane. Jack and bore the casing under Vicksburg Lane and add a gate valve at the point of connection. Identify trees in outlot C that will be removed for water main constriction. (11) Move Manhole 25 to a point 30 feet south, so the sewer service to Lot 20, Block 9 does not cross the south lot line of Lot 19, Block 9. (12) Install two removable bollards on both ends of the secondary emergency access between Lots 14 and 15, Block 9, per detail STRT-24. e. Include a storm water protection plan including the responsible parties and contact information. 7. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted, and b. Silt fence and tree preservation fencing installed consistent with city code. 8. Prior to or in conjunction with the final phase of this development, the water main shall be connected to fiiture water main in Dunkirk Lane or to Vicksburg Lane via outlot C. 9. Standard Conditions: a. With the exception of a model home, no building permits shall be issued until the final plat, agreements, and easements are filed and recorded with Hennepin County. b. Compliance with the city's tree preservation regulations. c. Removal of all hazardous trees from the property at the owner's expense. d. This approval shall expire one year after the date of approval, unless the applicant has applied for final plat approval, or unless the applicant has received prior approval from the Res. 2012-075 File 2011095 Page 5 city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
