HomeMy WebLinkAboutCity Council Resolution 2012-074CITY OF PLYMOUTH RESOLUTION NO. 2012-074 A RESOLUTION APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF DUNKIRK LANE AND COUNTY ROAD 47 (201 1095) WHEREAS, GWS Land Development of Plymouth, LLC. has requested reclassification of the zoning from FRD (future restricted development district) to RSF-3 (single family detached 3) for the roughly 60 -acre site presently legally described as follows: PARCEL 1: All of the Northeast Quarter of Section 5, Township 118, Range 22, lying westerly of the west line of the East 5/8th of the Northeast Quarter of Section 5, Township 118, Range 22, and lying southerly of the right of way of County Road 47, Hennepin County, Minnesota. PARCEL 2: Commencing at the northwest corner of the south 1530 feet of the east 759 feet of the Northeast Quarter of Section 5, Township 118 North, Range 22; thence on an assumed bearing of South 00 degrees 00 minutes 12 seconds West along the west line of said east 759 feet of Northeast Quarter a distance of 22 feet to the point of beginning; thence South 70 degrees 24 minutes 32 seconds West a distance of 170.43 feet; thence South 00 degrees 09 minutes 50 seconds West a distance of 318.76 feet; thence South 70 degrees 24 minutes 32 seconds West a distance of 757.87 feet to the west line of the East 5/8th of said Northeast Quarter; thence South 00 degrees 09 minutes 50 seconds West along said west line of the East 5/8th a distance of 883.16 feet to the southwest corner of said East 5/8th of Northeast Quarter; thence North 89 degrees 29 minutes 36 seconds East along the south line of said Northeast Quarter a distance of 885.40 to the west line of said east 759 feet of Northeast Quarter; thence North 00 degrees 00 minutes 12 seconds East a distance of 1508 feet to the point of beginning, Hennepin County, Minnesota. Also: The south 30 feet of the East 759 feet of said Northeast Quarter, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to RSF-3. Resolution 2012-074 (2011095) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD to RSF-3 for the roughly 60 -acre site located at the southeast corner of the intersection of Dunkirk Lane and County Road 47 (as legally described above), based on the following findings: I. The RSF-3 zoning and proposed density would be consistent with the LA -R2 guiding, pursuant to the comprehensive plan. 2. The proposed single-family development would be consistent with the comprehensive plan and would comply with city standards. 3. Adequate infrastructure, would be available to support RSF-3 zoning and the proposed development for this site. Approved this 28th day of February 2012. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
