HomeMy WebLinkAboutCity Council Resolution 2014-138CITY OF PLYMOUTH RESOLUTION 2014-138 APPROVING FINDING OF FACT DENYING AN APPLICATION FOR AN AMENDMENT TO CHAPTER 21 OF THE PLYMOUTH CITY CODE, THE ZONING ORDINANCE, CONCERNING DOCKS WHEREAS, Daniel Gustafson has applied for a text amendment to Chapter 21 of the Plymouth City Code, the Zoning Ordinance, to allow docks as a principal or an accessory use with no setback in the RSF zoning districts; and WHEREAS, the Planning Commission has reviewed the application at a duly called Public Hearing. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that Gustafson's application for a text amendment is denied based on the following findings: 1. Setbacks from lot lines for docks are necessary to reduce boating safety hazards, provide space to maneuver boats, provide separation of uses, and to prevent conflicts with uses on abutting lots. 2. The Purpose of the RSF zoning districts is single and two family homes and neighborhoods. Docks as a principal use would be inconsistent with that purpose. The docks could be used for commercial purposes and could result in increased activity and traffic, which would conflict with the quietude of the neighborhoods. Since no one would reside on property with a dock as a principal use, upkeep and maintenance would be problematic.
