HomeMy WebLinkAboutCity Council Resolution 2014-136CITY OF PLYMOUTH RESOLUTION No. 2014-136 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "BRYNWOOD" FOR PROPERTY LOCATED AT 5635 VICKSBURG LANE (2013095-F) WHEREAS, K. Hovnanian Homes of Minnesota, LLC has requested approval of a final plat for 37 lots and two outlots on roughly 40 acres located at 5635 Vicksburg Lane; and WHEREAS, the property is presently legally described as follows: The Northeast Quarter of the Southeast Quarter of Section 5, Township 118 North, Range 22, West of the Fifth Principal Meridian, Hennepin County, Minnesota. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by K. Hovnanian Homes of Minnesota, LLC for a final plat for Brynwood; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Brynwood is approved in accordance with the plans received by the city on February 14, 2014, except as may be amended by this resolution. 2. Prior to commencement of grading operations, the developer shall install and request inspection of tree preservation fencing and silt fencing. 3. Prior to recording the final plat, the developer shall: a. Remove the existing structures from the site. Demolition permits are required for removal of existing structures. b. Provide a separate ten -foot wide trail easement along the east side of those properties that abut Vicksburg Lane. c. Provide additional drainage and utility easements over Lots 3 thru 5, Block 4 for the 12 -foot wide maintenance access to Pond 2. d. Execute the development contract and provide the related financial guarantees and fees. e. Receive city approval of final construction plans. Resolution 2014-136 File 2013095-F Page 2 f. Dedicate and convey Outlot A to the city by warranty deed, free and clear of any and all encumbrances. g. Pay the deferred assessments. 4. Prior to recording the final plat, the developer shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Add notes to grading/ erosion control plan: a) Grade right-of-way per City Detail STR-29; and b) All site grading must be completed, certified by the Engineer and all off road grading equipment removed, before starting any utility work. b. Necessary permits and approvals required from other agencies: MPCA, Minnesota Department of Health, Shingle Creek Watershed Management Commission, NPDES, City of Plymouth, and Hennepin County. c. Street and utility plans: (1) Show hazard (OMI -2), "Keep Right" (R4-7) and delineator signs in median at 57th Avenue at the Vicksburg Lane intersection. (2) Show drainage and utility easements on all plan sheets. (3) Call out striping size, color and starts and stops on Sheet C7.04. Text is not required for directional arrows. (4) Add "Right Turn Lane" sign on shoulder of southbound Vicksburg Lane at beginning of right turn lane. (5) Add note to Sheet C7.04: Single lane closures shall only occur on weekdays between 9:00 a.m. and 3:00 p.m. (6) Add notes to typical turn lane section on sheet C7.04: a) MnDot Class II gravel shoulders; b) Wear course shall be SPWEA340C; c) Binder course shall be SPNWB330C; d) Base course shall be SPNWB330C; and e) Aggregate base shall be Class 5 or 7 MnDot Spec. 3149.2B2. (7) Add to street construction notes: a) All site grading must be completed, certified by the Engineer and all off road grading equipment removed, before starting any utility work; and b) All sanitary sewer service pipe shall be Schedule 40 PVC only. (8) Remove Note A under "Street Construction Notes". (9) Call out size and type of existing storm sewer culvert crossing Vicksburg Lane south of 57th Avenue. (10) Add "No Outlet" signs on the north side of 57th Avenue approximately 200 feet west of Vicksburg Lane and at the northeast corner of Weston Lane and 5th Avenue. (11) Add a gate valve on the north side of the cross at the intersection of Weston Lane and 57th Avenue. (12) Move the gate valve on the west side of the cross at Weston Lane and 57th Avenue to 40 feet back from the plug at the terminus of 57th Avenue. (13) Move the gate valve on the east side of the cross at Weston Lane and 57th Avenue to the west side of the 18 inch steel casing crossing Vicksburg Lane. Resolution 2014-136 File 2013095-F Page 3 (14) Use a new gate valve at the connection to the existing watermain at the south end of Weston Lane. (15) Space valves at intersections per Detail STRT-18. (16) All "B" curb to be B-618 type. (17) Show and call out signage on all Street & Storm Sewer sheets. (18) Call out class of all RCP storm sewer pipe. (19) Relocate outlet pipe from Pond 1 to outlet close to the existing culvert crossing Vicksburg Lane south of 57th Avenue. (20) Show sidewalk connecting to 57th Ave at Vicksburg Lane. (21) Call out to connect the concrete sidewalk to the north end of existing Weston Lane within the Spring Meadows plat. (22) Relocate STMH 702 and 701 to be in roadway pavement and call out EOF's between lots 3 and 4 and lots 4 and 5. (23) Use most current standard details dated March 2014. (24) Call out no Trash Guard to be installed on FES 100. (25) Change street name from "Yuma Lane North" to 57th Place North". d. Modify the storm water management plan to reflect exit of outlet pipe from Pond 1 to Vicksburg Lane drainage ditch south of 57th Avenue. e. Remove the signature bar for the city engineer from the final plat. 5. Prior to issuance of building permits for lots that abut wetlands, permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 6. Prior to issuance of building permits for lots that abut the Northwest Greenway, the developer shall install parkland signs/monuments to delineate the park property, in locations as required by the City Parks Department. 7. Prior to issuance of building permits for Lot 6, Block 1 and Lot 1, Block 2, the developer shall install the city trail segment between Blocks 1 and 2. 8. The developer shall preserve the southerly row of spruce trees that would not lie within the right-of- way, for the area north of 5510 Weston Lane in the Spring Meadows subdivision, as is shown on the revised tree preservation plan received by the city on November 27, 2013. 9. The homeowner's association documents shall address: a) responsibilities for maintenance and repair of the amenity lot (swimming pool area), wetland buffers, buffer monuments, filtration basin, sidewalks, landscaped median island at the site entrance (57th Avenue near Vicksburg Lane), and any other similar or common features, and b) prohibition on structures and the clearing of native vegetation from the wetland buffers. 10. The developer shall notify potential buyers about future roadway extensions and about the future street improvement project for Vicksburg Lane. Resolution 2014-136 File 2013095-F Page 4 11. The sidewalks along all streets shall be installed at the same time the streets are installed. 12. Except for the landscaped median island at the site entrance (57th Avenue near Vicksburg Lane), no trees shall be planted in the boulevard. 13. Standard conditions: a. Except for one model home, no building permits shall be issued until the final plat, HOA documents, and all easements and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Any signage shall require separate permits and shall comply with the city's signage regulations. c. Development standards and setbacks shall comply with the RSF-2 zoning standards. No variances are granted or implied. d. Compliance with the city's tree preservation regulations. e. Removal of all dead or hazardous trees from the property at the owner's expense. f. Record plans in a format as prescribed by the City shall be submitted prior to the release of financial guarantees. g. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
