HomeMy WebLinkAboutCity Council Resolution 2013-089CITY OF PLYMOUTH RESOLUTION No. 2013-089 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR GWS LAND DEVELOPMENT OF PLYMOUTH LLC. FOR "TERRA VISTA 2ND ADDITION" FOR PROPERTY LOCATED AT THE INTERSECTION OF DUNKIRK LANE AND 59TH AVENUE NORTH (2013008) WHEREAS, GWS Land Development of Plymouth, LLC. has requested approval of a final plat for 48 new single-family lots and two outlots on the roughly 35 -acre parcel presently legally described as follows: Outlot A Terra Vista, Hennepin County, Minnesota. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by GWS Land Development of Plymouth, LLC. for a final plat for "Terra Vista 2"a Addition"; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FUTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Terra Vista is approved in accordance with the plans received by the city on January 31, 2013, except as may be amended by this resolution. 2. Prior to disturbance of wetland 2, the applicant shall obtain approval of a wetland replacement plan. 3. Prior to recording the final plat, the applicant shall: 1) pay the park dedication cash fee; 2) receive City approval of final constriction plans; and 3) execute a development contract and submit related financial guarantees and fees. 4. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with applicable city code or zoning ordinance requirements: Res. 2013-089 File 2013008 Page 2 a. Provide HOA documents for the development that include language addressing the following: 1) prohibition of strictures and vegetation clearing in the wetland buffers and 2) maintenance for common elements including buffer monuments, median plantings, mailboxes, monument signs, shared retaining walls, sidewalks, etc. b. Execute an encroachment agreement for retaining walls that are constricted within drainage and utility easements on Lots 9 and 10, Block 1; Lots 19-20, Block 2; and Lots 1 and 2, Block 4. c. Relocate the retaining wall on Lot 10 outside the wetland buffer. d. Add a hydrant at the lot line between Lots 6 and 7, Block 4 (on 59t1i Ave). e. Add wetland buffer monuments to wetlands 2 and 3 as required by section 21670 of the zoning ordinance. f. Indicate driveways on corner lots a minimum of 40 feet from the intersection of property lines. g. Indicate the Dunkirk Lane trail five feet from the curb. h. Indicate street names as follows on inset A of the plat drawing: 1) label Comstock Lane north of the 58t11 Avenue cul-de-sac and 2) label 58'11 Avenue south of the 58'11 Avenue cul- de-sac. i. Provide a financial guarantee for the constriction of the remainder of Dunkirk Lane from the pond to the south plat boundary. 5. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted, and b. Silt fence and tree preservation fencing installed consistent with city code. 6. Prior to or in conjunction with the third phase of this development, the watermain shall be connected to fiiture watermain in Dunkirk Lane or Vicksburg Lane. 7. Driveway access to Dunkirk Lane from Lots 4-6, Block 1 shall be prohibited. 8. Standard Conditions: a. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. b. Tree preservation and silt fencing shall be maintained throughout constriction. c. No trees shall be planted in the boulevard. d. No building permits shall be issued until the final plat, agreements, and easements are filed and recorded with Hennepin County. e. Compliance with the city's tree preservation regulations. f. Removal of all hazardous trees from the property at the owner's expense. g. Any signage shall require separate permits and shall comply with the city's signage regulations. h. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the Res. 2013-089 File 2013008 Page 3 property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
