HomeMy WebLinkAboutCity Council Resolution 2004-526CITY OF PLYMOUTH RESOLUTION 2004-526 DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED OCTOBER 18, 2004 FOR THE PROPOSED TARYN HILLS DEVELOPMENT BY LUNDGREN BROS. CONSTRUCTION, INC. (2004070) WHEREAS, the City Council has reviewed the Environmental Assessment Worksheet (EAW) for Taryn Hills on December 14, 2004; and, WHEREAS, pursuant to Minnesota Environmental Review Program riles, the City of Plymouth, acting as the responsible governmental unit, prepared and distributed an Environmental Assessment Worksheet (EAW) for the Taryn Hills project on October 18, 2004; and, WHEREAS, the 30 -day review period expired on November 24, 2004, and all comments and recommendations received from reviewing agencies and other interested parties have been considered; and, WHEREAS, it has been determined that the proposed project does not present a potential for environmental impacts of such significance that an Environmental Impact Statement would be required; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does make a Negative Declaration on the need for an Environmental Impact Statement (EIS) for the proposed project known as Taryn Hills for Lundgren Bros. Constriction, Inc. based on the Record of Decision and subject to the following conditions: 1. Compliance with all statements in the attached Record of Decision. Resolution 2004-526 (2004070) Page 2 2. Wetland mitigation shall occur as required by the appropriate permitting agencies. 3. Strict adherence to the City's Erosion Control Ordinance shall be met during constriction and until the site is re -vegetated. 4. The proposed development shall include constriction of on-site basins for storm water treatment that meet the National Urban Runoff Program (N [_]RP) water quality guidelines, as well as the MPCA's Best Management Practices Manual and City of Plymouth's water quality requirements. 5. The development of the site shall comply with the City's shoreland and floodplain overlay zoning district requirements. 6. The development of the site shall comply with the City's tree preservation and landscaping requirements. 7. The developer shall be required to dedicate the right-of-way needed to allow the future re -alignment and expansion of County Road 47 and Vicksburg Lane. The developer shall also be responsible for transportation improvements needed to ensure safe and convenient traffic flow and access for the development (e.g., turn lanes and a portion of the cost of the fiiture traffic signal at the County Road 47/Cheshire Lane intersection). 8. As part of the planning and development review process, the developer shall provide the City with a plan to mitigate the traffic noise impacts on the affected dwelling units proposed within the development. 9. The requirement for a neighborhood park or mini -park north of County Roadd 47 will need to be addressed by the developer and City as the project proceeds through the development review process. 10. Buffering and landscaping shall be incorporated in the final plans to provide appropropriate land use transitions between the commercial area and the abutting residential areas.
