HomeMy WebLinkAboutCity Council Resolution 2004-510CITY OF PLYMOUTH RESOLUTION 2004-510 APPROVING ENCROACHMENT AGREEMENT FOR EXISTING BOULDER RETAINING WALL CONSTRUCTED ON LOT 3, BLOCK 1, FABER PLACE — 12200 29TH AVENUE WHEREAS, Darrell & Lynn Tibbets, are requesting the City to grant approval for an existing boulder retaining wall to remain in a public drainage and utility easement on the subject property; and WHEREAS, the encroachment agreement only permits the encroachment of the boulder retaining wall within the easement and all related facilities must still meet all applicable City codes; and WHEREAS, the existing retaining wall acts as erosion control for a pathway that was graded on the property for the maneuvering of a motorized scooter; and WHEREAS, the property is legally described as Lot 3, Block 1, Faber Place; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth an encroachment agreement that will allow for the existing boulder retaining wall to remain in the public drainage and utility easement on the subject property.
